Trosglwyddo cyflogeion i'r trosglwyddai
2.—(1) Yn ddarostyngedig i baragraff (3), trosglwyddir contract cyflogaeth unrhyw berson a oedd yn union cyn y dyddiad trosglwyddo yn cael ei gyflogi gan yr hen ymddiriedolaeth i'r ymddiriedolaeth newydd ar y dyddiad trosglwyddo a bydd y contract hwnnw'n effeithiol fel pe bai wedi'i wneud yn wreiddiol rhwng y person a gyflogir felly a'r ymddiriedolaeth newydd.
(2) Heb ragfarnu paragraff (1) uchod—
(a)yn rhinwedd yr erthygl hon, trosglwyddir yr holl hawliau, pwerau, dyletswyddau a rhwymedigaethau o dan gontract neu mewn cysylltiad â chontract y mae'r paragraff hwnnw'n gymwys iddo i'r ymddiriedolaeth newydd ar y dyddiad trosglwyddo;
(b)bernir bod unrhyw beth a wnaed cyn y dyddiad hwnnw gan yr hen ymddiriedolaeth neu mewn perthynas â hi ynglŷn â'r contract hwnnw neu'r cyflogai hwnnw, o'r dyddiad trosglwyddo ymlaen wedi'i wneud gan yr ymddiriedolaeth newydd neu mewn perthynas â hi.
(3) Nid yw paragraffau (2) a (3) uchod yn rhagfarnu unrhyw hawl sydd gan unrhyw gyflogai i derfynu ei gontract cyflogaeth os gwneir newid sylweddol er niwed i'r cyflogai yn ei amodau gwaith, ond ni fydd unrhyw hawl o'r fath yn codi yn unig oherwydd y newid mewn cyflogwr a bernir gan yr erthygl hon.
