Darpariaethau arbediad a throsiannol ac amddiffyniadau
12.—(1) Er gwaethaf dirymiad Rheoliadau Deunyddiau ac Eitemau mewn Cysylltiad â Bwyd 1987(1), o ran caen cellwlos atgynyrchiedig a weithgynhyrchwyd cyn 29ain Ebrill 1994, mae'r amddiffyniadau yn rheoliad 6A o'r Rheoliadau hynny'n gymwys o ran troseddau o dan y Rheoliadau hyn yn yr un modd ag yr oeddynt yn gymwys i droseddau o dan y darpariaethau cyfwerth yn y Rheoliadau hynny.
(2) Mewn unrhyw achos cyfreithiol ynglyn â throsedd o dorri rheoliad 10(3), (4), (6) neu (7), neu reoliad 11(1) neu (3), mae'n amddiffyniad i brofi —
(a)bod y weithred a oedd yn drosedd wedi ei chyflawni mewn perthynas â deunydd neu eitem a wnaed o gaen cellwlos atgynyrchiedig a oedd wedi ei weithgynhyrchu neu ei fewnforio i'r Gymuned Ewropeaidd cyn 29ain Ionawr 2006; a
(b)na fuasai'r weithred a oedd yn drosedd wedi bod yn drosedd o dan Reoliadau Deunyddiau ac Eitemau mewn Cysylltiad â Bwyd 1987 yn union cyn i Reoliadau Deunyddiau ac Eitemau mewn Cysylltiad â Bwyd (Cymru) 2005 ddod i rym(2).
