Gorchymyn Awdurdodau Lleol (Trefniadau Gweithredol a Threfniadau Amgen) (Addasu Deddfiadau a Darpariaethau Eraill) (Cymru) 2002

Y dreth gyngor a thaliadau cymunedol: cyfyngiadau ar bleidleisio

27.—( 1) Yn adran 106 o Ddeddf Cyllid Llywodraeth Leol 1992 (y dreth gyngor a thaliadau cymunedol: cyfyngiadau ar bleidleisio)—

(a) yn is-adran (1), ar ôl “(including in either case a sub-committee),” mewnosodwch “or a council manager within the meaning of section 11(4)(b) of the Local Government Act 2000,”;

(b) yn is-adran (2)—

(i) ar ôl “a member” mewnosodwch “or a council manager”; a

(ii) ar ôl “or committee” mewnosodwch “or in the case of an authority which are operating executive arrangements the executive of that authority or any committee of that executive”; ac

(c) ar ôl is-adran (2), mewnosodwch—

“(2A) In the case of an authority which are operating executive arrangements, if or to the extent that any matter listed in paragraphs (a), (b) or (c) of subsection (2) is the responsibility of the executive of that authority, no member of the executive to whom this section applies shall take any action or discharge any function with respect to that matter.”.

(2) Yn adran 116 o Ddeddf Cyllid Llywodraeth Leol 1992 (dehongli: cyffredinol), ar ôl y diffiniad o “the Social Security Acts” mewnosodwch—

““executive” and “executive arrangements” have the same meaning as in Part II of the Local Government Act 2000;”.
