Mae'r Gorchymyn hwn yn diddymu Gorchymyn Pysgota Môr (Gorfodi Mesurau Cadwraeth y Gymuned) 1997 (O.S. 1997/1949) a Gorchymyn Pysgota Môr (Gorfodi Mesurau Cadwraeth y Gymuned) (Diwygio) 1997 (O.S. 1997/2841) i'r graddau y maent yn gymwys i Gymru (erthygl 15).
Mae'r Gorchymyn yn ail-ddeddfu darpariaethau ar gyfer gorfodi Erthygl 11 o Reoliad y Cyngor (EC) Rhif 894/97 (OJ Rhif L132, 23.5.97, t.1) sy'n pennu mesurau technegol penodol ar gyfer cadw adnoddau pysgodfeydd (“Rheoliad 894/97”).
Mae'r Gorchymyn hefyd yn gwneud darpariaeth ar gyfer gorfodi cyfyngiadau a rhwymedigaethau a gynhwysir yn Rheoliad y Cyngor (EC) Rhif 850/98 (OJ Rhif L125, 27.4.98, t.1), ar gyfer cadw adnoddau pysgodfeydd drwy gyfrwng mesurau technegol i amddiffyn organeddau morol ifanc, fel y'i diwygiwyd (“Rheoliad 850/98”).
Mae Erthygl 3 o'r Gorchymyn yn creu tramgwyddau mewn perthynas â thorri: Erthygl 11 o Reoliad 894/97; darpariaethau Rheoliad 850/98 y cyfeirir atynt yng ngholofn 1 (ac a ddisgrifir yn fyr yng ngholofn 2) o'r Atodlen i'r Gorchymyn; darpariaethau Rheoliad 850/98 y cyfeirir atynt yn erthygl 3(2) ; a mesurau technegol sy'n gymwys yn 2000 yn rhinwedd Erthygl 9 o Reoliad y Cyngor (EC) 2742/99 (OJ Rhif L341, 31.12.99, t.1). Pennir cosbau, a all gynnwys fforffedu pysgod, rhwydi ac offer pysgota arall, ar gyfer y tramgwyddau hyn (erthygl 4).
Mae'r Gorchymyn yn rhoi pwerau gorfodi, mewn perthynas â chychod pysgota ac ar y tir, i swyddogion pysgodfeydd môr Prydeinig sy'n gweithredu yng Nghymru ac yn y môr cyfagos at Gymru. Mae'r pwerau hynny yn ymestyn i gipio pysgod ac offer pysgota (erthyglau 6, 7 ac 8). Rhoddir pwerau i swyddogion eraill hefyd mewn perthynas â physgod sy'n rhy fach a rhwydi ac offer pysgota (erthygl 9). Gwneir darpariaeth ar gyfer cosbi unrhyw un a geir yn euog o rwystro swyddog neu ymosod ar swyddog (erthygl 11).
Gwneir darpariaeth hefyd ar gyfer erlyn troseddwyr ac ar gyfer achosion gan bwyllgorau pysgodfeydd lleol (erthygl 13). £5,000 yw uchafswm statudol y gosb y cyfeirir ati yn y Gorchymyn ar hyn o bryd.
Mae'r Gorchymyn yn darparu pwerau ar gyfer casglu dirwyon a osodir gan lys ynadon (erthygl 5).
