Mae “iaith dramor fodern” yn un o bynciau sylfaen y Cwricwlwm Cenedlaethol yng Nghymru mewn perthynas â'r trydydd cyfnod allweddol. Mae'n ofynnol i'r ieithoedd hynny sydd i gyfrif fel ieithoedd modern at ddibenion y Cwricwlwm Cenedlaethol gael eu pennu mewn Gorchymyn a wneir gan y Cynulliad Cenedlaethol, neu, fel arall, caiff Gorchymyn o'r fath ddarparu bod unrhyw iaith dramor fodern yn iaith dramor fodern at y dibenion hynny.
Ieithoedd swyddogol y Gymuned Ewropeaidd yw'r ieithoedd a bennir gan y Gorchymyn ym mhob achos. Yn ychwanegol, yn achos ysgol lle cynigir cyfle i ddisgyblion y trydydd cyfnod allweddol astudio o leiaf un o ieithoedd swyddogol y Gymuned Ewropeaidd, mae'r Gorchymyn yn darparu bod “unrhyw” iaith dramor fodern yn iaith dramor fodern at ddibenion y Cwricwlwm Cenedlaethol. Yn hyn o beth, mae'n wahanol i Orchymyn Addysg (Y Cwricwlwm Cenedlaethol) (Ieithoedd Tramor Modern) 1991, y mae'n ei ddisodli, yn yr ystyr mai dim ond yr ieithoedd tramor modern hynny a restrwyd ynddo a bennwyd gan y Gorchymyn cynharach tra bod y Gorchymyn presennol yn pennu unrhyw iaith dramor fodern.
