Mae adran 354 o Ddeddf Addysg 1996 yn rhestru'r pynciau sy'n bynciau sylfaen at ddibenion y Cwricwlwm Cenedlaethol. Ar gyfer disgyblion yng Nghyfnod Allweddol 3 (Blynyddoedd 7-9 yn fras), mae un o'r pynciau sylfaen a restrir yn yr adran yn iaith dramor fodern a bennir drwy Orchymyn gan y Cynulliad Cenedlaethol. Mae'r Gorchymyn hwn yn diwygio adran 354 fel nad oes angen bellach i ieithoedd tramor modern gael eu pennu mewn Gorchymyn o dan yr adran honno. Yn lle hynny, caiff y Gorchymyn ddarparu bod unrhyw iaith dramor fodern yn iaith dramor fodern at ddibenion y Cwricwlwm Cenedlaethol.
Hefyd caiff Gorchymyn o dan yr adran fel y'i diwygiwyd —
(a)bennu'r amgylchiadau lle na ddylid trin iaith fel pwnc sylfaen, a
(b)darparu mecanwaith ar gyfer penderfynu unrhyw gwestiwn sy'n codi ynghylch a yw iaith benodol yn iaith dramor fodern.
Gwelir testun adran 354(1) i (5) fel y'i diwygiwyd yn Atodlen 2 i'r Gorchymyn.
