Explanatory Note

Section 84 of the Schools Standards and Framework Act 1998 requires the National Assembly to issue a Code of Practice containing such practical guidance as it thinks appropriate, in respect of the discharge of admission function by location education authorities, the governing bodies of foundation and voluntary aided schools and admission appeal panels.

Section 85 of the School Standards and Framework Act 1998 requires that the Code of Practice on Admission Appeals is brought into force by an Order.

The Code of Practice mainly applies to admission appeals for primary and secondary school intakes from 2000/2001 onwards and deals with two separate categories of admission appeals:

  • appeals by parents against a decision by a school admission authority to refuse to offer their child a place at the school in question; and

  • appeals by governing bodies of community or voluntary controlled schools against a decision by a LEA to admit to the school a child who has previously been permanently excluded from two or more schools.

This Order appoints 1st September 1999 as the day on which the National Assembly’s Code of Practice for School Admission Appeals takes effect. The Code, containing guidance to local education authorities and governing bodies of maintained schools on their responsibilities in respect of admissions appeals, has already been issued on 20th August 1999.Copies of both Codes may be obtained from the National Assembly for Wales, Cathays Park, Cardiff, CF10 3NQ. They are also accessible on the Internet at www.wales.gov.uk.
