The Social Security (Scotland) Act 2018 (Disability Assistance for Children and Young People) (Consequential Modifications) Order 2021

The Secretary of State makes the following Order in exercise of the powers conferred by sections 104, 112(1) and 113(2), (3) and (5) of the Scotland Act 1998(1).

Citation, commencement and extent

1.—(1) This Order may be cited as the Social Security (Scotland) Act 2018 (Disability Assistance for Children and Young People) (Consequential Modifications) Order 2021.

(2) This Order comes into force on 26th July 2021.

(3) Each amendment made by this Order has the same extent as the provision being amended.

Amendment of the Income Support (General) Regulations 1987

2.  Schedule 1 contains amendments to the Income Support (General) Regulations 1987(2).

Amendment of the Income Support (General) Regulations (Northern Ireland) 1987

3.  Schedule 2 contains amendments to the Income Support (General) Regulations (Northern Ireland) 1987(3).

Amendment of the Jobseeker’s Allowance Regulations 1996

4.  Schedule 3 contains amendments to the Jobseeker’s Allowance Regulations 1996(4).

Amendment of the Jobseeker’s Allowance Regulations (Northern Ireland) 1996

5.  Schedule 4 contains amendments to the Jobseeker’s Allowance Regulations (Northern Ireland) 1996(5).

Amendment of the Social Security and Child Support (Decisions and Appeals) Regulations 1999

6.—(1) The Social Security and Child Support (Decisions and Appeals) Regulations 1999(6) are amended as follows.

(2) In regulation 1(3) (interpretation etc), after the definition of “the Board”, insert—

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;(7).

(3) In regulation 3(7)(b) (revision of decisions), after both occurrences of “benefit”, insert “or child disability payment”.

(4) In regulation 6(2)(e)(ii) (supersession of decisions), after both occurrences of “benefit”, insert “or child disability payment”.

(5) In regulation 7(7)(a) (date from which a decision superseded under section 10 takes effect), after both occurrences of “benefit”, insert “or child disability payment”.

Amendment of the Social Security and Child Support (Decisions and Appeals) Regulations (Northern Ireland) 1999

7.—(1) The Social Security and Child Support (Decisions and Appeals) Regulations (Northern Ireland) 1999(8) are amended as follows.

(2) In regulation 1(2) (interpretation), before the definition of “claimant”, insert—

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021 in circumstances where regulation 36(1) of those Regulations applies;.

(3) In regulation 3(7)(b) (revision of decisions), after both occurrences of “benefit”, insert “or child disability payment”.

(4) In regulation 6(2)(e)(ii) (supersession of decisions), after both occurrences of “relevant benefit”, insert “or child disability payment”.

(5) In regulation 7(7)(a) (date from which a decision superseded under Article 11 takes effect), after both occurrences of “benefit”, insert “or child disability payment”.

Amendment of the Housing Benefit and Council Tax Benefit (Decisions and Appeals) Regulations 2001

8.—(1) The Housing Benefit and Council Tax Benefit (Decisions and Appeals) Regulations 2001(9) are amended as follows.

(2) In regulation 1(2) (interpretation etc), after the definition of “benefit week”, insert—

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

(3) In regulation 4(7B)(b) (revision of decisions)—

(a)after “Act”, insert “or child disability payment”;

(b)after the second occurrence of “benefit”, insert “or child disability payment”.

(4) In regulation 7(2)(i)(ii) (decisions superseding earlier decisions)—

(a)after “Act”, insert “or child disability payment”;

(b)after the second occurrence of “benefit”, insert “or child disability payment”.

(5) In regulation 8(14) (date from which a decision superseding an earlier decision takes effect) after both occurrences of “benefit”, insert “or child disability payment”.

Amendment of the Housing Benefit (Decisions and Appeals) Regulations (Northern Ireland) 2001

9.—(1) The Housing Benefit (Decisions and Appeals) Regulations (Northern Ireland) 2001(10) are amended as follows.

(2) In regulation 1(2) (citation, commencement and interpretation), after the definition of “benefit week”, insert—

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

(3) In regulation 4(6B)(b) (revision of decisions), after “Order” and after the second occurrence of “benefit”, insert “or child disability payment”.

(4) In regulation 7(2)(h)(ii) (decisions superseding earlier decisions), after “Order” and after the second occurrence of “benefit”, insert “or child disability payment”.

(5) In regulation 8(12) (date from which a decision superseding an earlier decision takes effect) after both occurrences of “benefit”, insert “or child disability payment”.

Amendment of Schedule 2A to the State Pension Credit Regulations 2002

10.—(1) Schedule 2A to the State Pension Credit Regulations 2002(11) is amended as follows.

(2) In paragraph 9 (amount of additional payment)—

(a)in sub-paragraph (2), after “disability living allowance”, insert “, child disability payment (within the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021(12))”;

(b)in sub-paragraph (3), after paragraph (a), insert—

(aa)entitled to the care component of child disability payment at the highest rate in accordance with regulation 11(5) of the Disability Assistance for Children and Young People (Scotland) Regulations 2021; or.

Amendment of Schedule 2A to the State Pension Credit Regulations (Northern Ireland) 2003

11.—(1) Schedule 2A to the State Pension Credit Regulations (Northern Ireland) 2003(13) (additional amount applicable for claimants responsible for a child or qualifying young person) is amended as follows.

(2) In paragraph 9 (amount of additional payment)—

(a)in sub-paragraph (2), after “disability living allowance”, insert “, child disability payment (within the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021)”;

(b)in sub-paragraph (3), after head (a), insert—

(aa)entitled to the care component of child disability payment at the highest rate in accordance with regulation 11(5) of the Disability Assistance for Children and Young People (Scotland) Regulations 2021; or.

Amendment of the Housing Benefit Regulations 2006

12.  Schedule 5 contains amendments to the Housing Benefit Regulations 2006(14).

18.—(1) Regulation 64 of the Child Support Maintenance Calculation Regulations 2012(20) (illness or disability of relevant other child) is amended as follows.

(2) In paragraph (2)—

(a)in sub-paragraph (a)(i), after “disability living allowance” insert “, child disability payment”;

(b)in sub-paragraph (a)(ii), after “disability living allowance” insert “, or the care component of child disability payment in accordance with regulation 11 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021,”;

(c)after sub-paragraph (a) insert—

(ab)child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021.

Amendment of the Child Support Maintenance Calculation Regulations (Northern Ireland) 2012

19.—(1) Regulation 63 of the Child Support Maintenance Calculation Regulations (Northern Ireland) 2012(21) (illness or disability of relevant other child) is amended as follows.

(2) In paragraph (2)(a)—

(a)in head (i)(22), after “armed forces independence payment” insert “, child disability payment”;

(b)in head (ii)(23), after “disability living allowance” insert “, or the care component of child disability payment in accordance with regulation 11 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021,”;

(c)after sub-paragraph (aa) insert—

(ab)child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021.

(3) In paragraph (3)(b)(24) after “armed forces independence payment” insert “, child disability payment”.

Amendment of the Universal Credit Regulations 2013

20.  Schedule 11 contains amendments to the Universal Credit Regulations 2013(25).

Amendment of the Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Decisions and Appeals) Regulations 2013

21.—(1) The Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Decisions and Appeals) Regulations 2013(26) are amended as follows.

(2) In regulation 2 (interpretation), after the definition of “child” insert—

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

(3) In regulation 12(b) (award of another benefit), after both occurrences of “benefit”, insert “or child disability payment”.

(4) In paragraph 31 of Schedule 1 (effective dates for superseding decisions made on the ground of a change of circumstances), in sub-paragraphs (1), (2)(a)(i), (2)(a)(ii) and (2)(a)(iii), after each occurrence of “benefit”, insert “or child disability payment”.

Amendment the Jobseeker’s Allowance Regulations 2013

22.—(1) Regulation 42 of the Jobseeker’s Allowance Regulations 2013(27) (remunerative work) is amended as follows.

(2) In paragraph (3)(c)—

(a)in paragraph (ii), after “disability living allowance”, insert “, child disability payment”;

(b)in paragraph (iv), after “disability living allowance”, insert “, child disability payment”.

(3) In paragraph (4)—

(a)after the definition of “armed forces independence payment”, insert—

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;

(b)for the definition of “care component” substitute—

care component” means—

(a)

the care component of disability living allowance at the highest or middle rate prescribed under section 72(3) of the Benefits Act; or

(b)

the care component of child disability payment at the highest or middle rate provided for in regulation 11(5) of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

Amendment of the Employment and Support Allowance Regulations 2013

23.—(1) Regulation 94 of the Employment and Support Allowance Regulations 2013(28) (meaning of “person in hardship”) is amended as follows.

(2) In paragraph (3)—

(a)in sub-paragraph (b), after “disability living allowance”, insert “, child disability payment”;

(b)in sub-paragraph (c)(ii), after “disability living allowance”, insert “, child disability payment”.

(3) In paragraph (7), for the definition of “care component” substitute—

care component” means—

(a)

the care component of disability living allowance at the highest or middle rate prescribed under section 72(3) of the Contributions and Benefits Act; or

(b)

the care component of child disability payment at the highest or middle rate provided for in regulation 11(5) of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

Amendment of the Universal Credit Regulations (Northern Ireland) 2016

24.  Schedule 12 contains amendments to the Universal Credit Regulations (Northern Ireland) 2016(29).

Amendment of the Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Decisions and Appeals) Regulations (Northern Ireland) 2016

25.—(1) The Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Decisions and Appeals) Regulations (Northern Ireland) 2016(30) are amended as follows.

(2) In regulation 2(1) (interpretation), after the definition of “child” insert—

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021 in circumstances where regulation 36(1) of those Regulations applies;.

Amendment of the Income Support (General) Regulations 1987: general

1.  The Income Support (General) Regulations 1987 are amended as follows.

Amendment of regulation 2 (interpretation)

2.  In regulation 2(1)—

(a)after the definition of “care home”, insert—

child disability payment” has the meaning given in regulation 2 of the DACYP Regulations;;

(b)after the definition of “Crown tenant”, insert—

DACYP Regulations” means the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

Amendment of regulation 4 (temporary absence from Great Britain)

3.  In regulation 4(2)(c)(v)(aa) after “allowance”, insert “, the care component of child disability payment at the highest rate in accordance with the DACYP Regulations (see regulation 11(5) of those Regulations)”.

Amendment of Schedule 1B (prescribed categories of person)

4.  In paragraph 4(a) of Schedule 1B (persons caring for another person)—

(3) In paragraph 13A (Enhanced Disability Premium), in sub-paragraph (1ZA)—

(a)omit the “or” at the end of paragraph (b);

(b)after that paragraph, insert—

(ba)the care component of child disability payment is payable to that person at the highest rate in accordance with the DACYP Regulations (see regulation 11(5) of those Regulations); or.

(4) In paragraph 14 (Disabled Child Premium)—

(a)in sub-paragraph (1), after paragraph (a), insert—

(aa)in receipt of child disability payment;;

(b)in sub-paragraph (2), in the opening words after “(1)(a)” insert “, (aa)”.

1.  The Income Support (General) Regulations (Northern Ireland) 1987 are amended as follows.

Amendment of regulation 2 (interpretation)

2.  In regulation 2(1)—

(a)after the definition of “child benefit”, insert—

child disability payment” has the meaning given in regulation 2 of the DACYP Regulations;;

(b)after the definition of “course of study”, insert—

DACYP Regulations” means the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

Amendment of regulation 4 (temporary absence from Northern Ireland)

3.  In regulation 4(2)(c)(v)(aa) after “allowance”, insert “, the care component of child disability payment at the highest rate in accordance with the DACYP Regulations (see regulation 11(5) of those Regulations)”.

Amendment of Schedule 1B (prescribed categories of person)

4.  In paragraph 4(a) (persons caring for another person) of Schedule 1B—

(3) In paragraph 13A (enhanced disability premium), in sub-paragraph (1ZA)—

(a)omit the “or” at the end of (b);

(b)after that head, insert—

(ba)the care component of child disability payment is payable to that person at the highest rate in accordance with the DACYP Regulations (see regulation 11(5) of those Regulations); or.

(4) In paragraph 14 (disabled child premium)—

(a)in sub-paragraph (1), after head (a), insert—

(aza)in receipt of child disability payment;;

1.  The Jobseeker’s Allowance Regulations 1996 are amended as follows.

2.  In regulation 1(3)—

(a)after the definition of “the Caxton Foundation”, insert—

child disability payment” has the meaning given in regulation 2 of the DACYP Regulations;

(b)after the definition of “Crown tenant”, insert—

DACYP Regulations” means the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

Amendment of regulation 51 (remunerative work)

3.  In regulation 51(3)(c)—

(a)in paragraph (i), after “middle rate:” insert “the care component of child disability payment at the highest or middle rate in accordance with regulation 11(5) of the DACYP Regulations,”;

(b)in paragraph (ii), after “disability living allowance,” insert “child disability payment,”;

(c)after paragraph (iv), insert—

(iva)a person who has claimed child disability payment and has an award of the care component of child disability payment at the highest or middle rate in accordance with regulation 11(5) of the DACYP Regulations for a period commencing after the date on which the claim was made;.

4.  In regulation 140(1)(h)—

(a)in paragraph (i), after “Benefits Act”, insert “, the care component of child disability payment at the highest or middle rate in accordance with regulation 11(5) of the DACYP Regulations”;

(b)in paragraph (ii), after “disability living allowance”, insert “, child disability payment”;

(c)after paragraph (iii), insert—

Amendment of regulation 2 (interpretation)

2.  In regulation 2—

(a)after the definition of “carer element”, insert—

child disability payment” has the meaning given in the DACYP Regulations (see regulation 2 of those Regulations);;

(b)after the definition of “course of advanced education”, insert—

the DACYP Regulations” means the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

Amendment of regulation 14 (exemption to the requirement not to be receiving education)

3.  In regulation 14(1)(b), after “disability living allowance”, insert “, child disability payment”.

Amendment of regulation 25 (the child element)

4.  In regulation 25(2)—

(a)in sub-paragraph (a), after “disability living allowance”, insert “, child disability payment”;

(b)in sub-paragraph (b)(i), after “highest rate”, insert “, the care component of child disability payment at the highest rate in accordance with regulation 11(5) of the DACYP Regulations”.

Amendment of regulation 42 (when an assessment may be carried out)

5.  In regulation 42(2)(a), after “disability living allowance”, insert “, child disability payment”.

Amendment of regulation 83 (exceptions – entitlement or receipt of certain benefits)

6.  In regulation 83(1), after paragraph (i), insert—

(ia)a claimant, or a child or qualifying young person for whom a claimant is responsible, is receiving child disability payment;.

Amendment of Schedule 3 (claimant treated as occupying or not occupying accommodation)

7.—(1) Schedule 3 is amended as follows.

(2) In paragraph 4(3)(b), after sub-head (i), insert—

(ia)the care component of child disability payment at the middle or highest rate in accordance with regulation 11(5) of the DACYP Regulations;.

Amendment of Schedule 4 (housing costs element for renters)

8.—(1) Schedule 4 is amended as follows.

(2) In paragraph 11—

(a)in sub-paragraph (3)(a), after sub-head (i), insert—

(ia)the care component of child disability payment at the middle or highest rate in accordance with regulation 11(5) of the DACYP Regulations;.

(b)in sub-paragraph (6), after head (a), insert—

(aa)in receipt of the care component of child disability payment at the middle or highest rate in accordance with regulation 11(5) of the DACYP Regulations;;

(c)in sub-paragraph (6A)(a), after sub-head (i), insert—

(ia)the care component of child disability payment at the middle or highest rate in accordance with regulation 11(5) of the DACYP Regulations;.

(3) In paragraph 14(2), after head (b), insert—

(ba)in receipt of the care component of child disability payment at the middle or highest rate in accordance with regulation 11(5) of the DACYP Regulations;.

(4) In paragraph 28(4), after head (a), insert—

(aa)the care component of child disability payment at the middle or highest rate in accordance with regulation 11(5) of the DACYP Regulations;.

EXPLANATORY NOTE

(This note is not part of the Order)

The Disability Assistance for Children and Young People (Scotland) Regulations 2021 (S.S.I. 2021/174) made under section 31 of the Social Security (Scotland) Act 2018 (asp 9) introduce arrangements for the payment of disability assistance for children and young people in the form of a “child disability payment”. The child disability payment replaces the disability living allowance for children residing in Scotland.

This Order makes consequential amendments to social security legislation in England and Wales, Scotland and Northern Ireland governing entitlement to certain benefits. Child disability payment is only available to children and young people residing in Scotland. However, the Scottish Government will continue to make payment of child disability payment to any child or young person who relocates from Scotland to another part of the United Kingdom for a period of 13 weeks, from the date of the move, to allow for an application for disability living allowance to be processed.

A full Impact Assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
