THE SCHEDULETHE HIGHWAYS ENGLAND M58 JUNCTION 1 IMPROVEMENT (SPECIAL ROADS) SCHEME 2020

Highways England Company Limited (Highways England), being a strategic highways company appointed for the time being under Part 1 of the Infrastructure Act 2015 and the highways authority for the M58 Motorway, make this Scheme in exercise of its powers under Sections 16 (3), 16(5)(b), 16 (5)(c), 17 and 19 of the Highways Act 1980 –

1 Highways England are authorised to provide for the use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Act, special roads along the routes described in the Schedule for the purpose of connecting the M58 Motorway with Junction 1 of that motorway.

2 The centre line of each of the special roads is indicated by a heavy black line on the plan.

3 Each of the special roads shall become a trunk road on the date when this Scheme comes into force.

4 In this Scheme –

(i)“the Act”means the Highways Act 1980;
(ii)“Highways England”Means the Highways England Company Limited, which is a strategic highways company (Company No 9346363), which is a company registered in England and Wales and whose Registered Office is Bridge House, Walnut Tree Close, Guildford, Surrey, GU1 4LZ;
(iv)“the plan”means the plan numbered M58J1-ATK-HGN-XX-DR-D-0001 marked “The Highways England M58 Junction 1 Improvement (Special Roads) Scheme 2020”, signed on behalf of Highways England Company Limited, Records Management, Lateral, 8 City Walk, Leeds, LS11 9AT; a duplicate copy has been deposited at the offices of the Secretary of State for Transport;
(v)“the Schedule”means the Schedule to this Scheme;
(vi)“the special roads”Means the special roads which highways England are authorised by this Scheme to provide.

5 This Scheme may be cited as “The Highways England M58 Junction 1 Improvement (Special Roads) Scheme 2020” and this Scheme shall become operative on the date on which the Secretary of State publishes a notice in accordance with paragraphs 1 and 4 of Schedule 2 of the Highways Act 1980 stating it has been confirmed.
