Coming into force in accordance with article 1

The Secretary of State for Transport makes this Instrument in exercise of the powers conferred by Sections 16, 17 and 19 of the Highways Act 1980(1) and now vested in him(2):

In accordance with section 16(8) of that Act, the Secretary of State has taken into consideration the requirements of local and national planning, including the requirements of agriculture.

This Instrument is made in compliance with the provisions of Part II of Schedule 1 to that Act.

1.  This Instrument may be cited as The Highways England M58 Junction 1 Improvement (Special Roads) Scheme 2020 Confirmation Instrument 2021 and shall become operative on the date on which the notice is first published in accordance with paragraph 1 & 4 of Schedule 2 of the Highways Act 1980 stating it has been confirmed.

2.  The Highways England M58 Junction 1 Improvement (Special Roads) Scheme 2020 (“the Scheme”) is hereby confirmed with modifications.

3.  The Scheme as confirmed is set out in the Schedule hereto and copies of the Scheme with its accompanying plan are deposited at the offices of the Department for Transport, MHCLG, 1 Priory Square, Priory Street, Hastings, East Sussex, TN34 1EA and at the offices of Highways England Company Limited, Lateral, 8 City Walk, Leeds LA11 9AT.

THE SCHEDULETHE HIGHWAYS ENGLAND M58 JUNCTION 1 IMPROVEMENT (SPECIAL ROADS) SCHEME 2020

Highways England Company Limited (Highways England), being a strategic highways company appointed for the time being under Part 1 of the Infrastructure Act 2015 and the highways authority for the M58 Motorway, make this Scheme in exercise of its powers under Sections 16 (3), 16(5)(b), 16 (5)(c), 17 and 19 of the Highways Act 1980 –

1 Highways England are authorised to provide for the use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Act, special roads along the routes described in the Schedule for the purpose of connecting the M58 Motorway with Junction 1 of that motorway.

2 The centre line of each of the special roads is indicated by a heavy black line on the plan.

3 Each of the special roads shall become a trunk road on the date when this Scheme comes into force.

4 In this Scheme –

(i)“the Act”means the Highways Act 1980;
(ii)“Highways England”Means the Highways England Company Limited, which is a strategic highways company (Company No 9346363), which is a company registered in England and Wales and whose Registered Office is Bridge House, Walnut Tree Close, Guildford, Surrey, GU1 4LZ;
(iv)“the plan”means the plan numbered M58J1-ATK-HGN-XX-DR-D-0001 marked “The Highways England M58 Junction 1 Improvement (Special Roads) Scheme 2020”, signed on behalf of Highways England Company Limited, Records Management, Lateral, 8 City Walk, Leeds, LS11 9AT; a duplicate copy has been deposited at the offices of the Secretary of State for Transport;
(v)“the Schedule”means the Schedule to this Scheme;
(vi)“the special roads”Means the special roads which highways England are authorised by this Scheme to provide.

5 This Scheme may be cited as “The Highways England M58 Junction 1 Improvement (Special Roads) Scheme 2020” and this Scheme shall become operative on the date on which the Secretary of State publishes a notice in accordance with paragraphs 1 and 4 of Schedule 2 of the Highways Act 1980 stating it has been confirmed.

THE SCHEDULE TO THE SCHEMETHE ROUTES OF THE SPECIAL ROADS

The special roads are two new slip roads at Junction 1 of the M58 Motorway in the Parish of Maghull, in the Borough of Sefton, in the County of Merseyside along the following routes:

A route (given the reference number 1 on the plan) connecting the eastbound carriageway of the M58 motorway to Junction 1 of that motorway, being a distance of 534 metres.

A route (given the reference number 2 on the plan) connecting Junction 1 of the M58 Motorway to the westbound bound carriageway of that motorway, being a distance of 561 metres.

EXPLANATORY NOTE

(This note is not part of the Instrument)

This Instrument confirms a Scheme to provide two new special roads at the location of Junction 1 of the M58 Motorway in the Parish of Maghull, in the Borough of Sefton in the County of Merseyside.

The Secretary of State has modified this Special Roads Scheme as follows:

1. “THE SCHEDULE” is amended to “THE SCHEDULE TO THE SCHEME”.

2. In the Schedule to the Scheme in the first paragraph the wording “the construction of which is authorised by a planning permission granted by Sefton MBC on 18th October 2017 under reference DC/2017/00953” is deleted.

3. In the Schedule to the Scheme in both descriptions 1 and 2 the wording “provided by means of appropriation as a special road by Highways England by an order under section 18 of the Act” is deleted.
