The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018(1).

The requirements of paragraph 3(2) of Schedule 7 to that Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Climate and Energy (Revocation) (EU Exit) Regulations 2021, and come into force on the 22nd day after the day on which these Regulations are laid.

(2) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Revocation of retained direct EU legislation

2.—(1) The EU regulations(2) set out in Table 1 of the Schedule are revoked.

(2) The EU decisions(3) set out in Table 2 of the Schedule are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made in exercise of the powers in section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under paragraph (a) of section 8(2) of that Act) arising from the withdrawal of the United Kingdom from the European Union.

These Regulations revoke retained direct EU legislation in the field of climate change and energy that has no practical application in relation to the United Kingdom.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
