The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 149(3) and 160(1) of the Transport Act 2000(1).

Citation and commencement

1.—(1) These Regulations may be cited as the Mandatory Travel Concession (England) (Amendment) Regulations 2021.

(2) These Regulations come into force on the 22nd day after the day on which they are laid.

Extent

2.  These Regulations extend to England and Wales.

Amendment of Regulations

3.—(1) The Mandatory Travel Concession (England) Regulations 2011(2) are amended as follows.

(2) In regulation 6, for “It” substitute “Subject to regulation 6A, it”.

(3) After regulation 6 insert—

6A.  During the period beginning with 24th March 2021 and ending at the end of 5th April 2022, regulation 6 applies as if the words “no better and” in sub-paragraph (a) were omitted..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Mandatory Travel Concession (England) Regulations 2011 (the “2011 Regulations”).

The 2011 Regulations make provision for the reimbursement arrangements between travel concession authorities and operators of public passenger transport services providing concessions under section 145A of the Transport Act 2000. These Regulations temporarily remove the requirement in the 2011 Regulations that it must be an objective of a travel concession authority when formulating reimbursement arrangements that the operator is no better off as a result of providing a concession. These Regulations reinstate that requirement from 6th April 2022.

A full Impact Assessment has not been produced for this instrument as it is not expected to have a significant impact on the private, public or voluntary sectors. An Explanatory Memorandum has been prepared for these Regulations and is available alongside this instrument on the UK Legislation website, www.legislation.gov.uk.
