The Secretary of State makes the following Order in exercise of the powers conferred by section 9(4) and 9(4A) of the Local Government and Housing Act 1989(1).
1.—(1) This Order may be cited as the Local Government (Assistants for Political Groups) (Remuneration) (England) Order 2021 and comes into force on 6th December 2021.
(2) This Order extends to England and Wales and applies to relevant authorities in England only(2).
2. In this Order—
“the Act” means the Local Government and Housing Act 1989;
“the National Joint Council” means the National Joint Council for Local Government Services(3); and
“the National Joint Council’s Scheme” means the National Joint Council’s National Agreement on Pay and Conditions of Service(4).
3.—(1) The point specified for the purposes of section 9(4)(a) of the Act is spinal column point 38 of the salary scales for local government officers incorporated in the National Joint Council’s Scheme.
(2) The amount which corresponds to the point specified in paragraph (1) is such amount as is published by the National Joint Council from time to time with respect to full-time posts under a local authority in England and Wales.
4. The Local Government (Assistants for Political Groups) (Remuneration) (England) Order 2006(5) is revoked.

One of the requirements relating to the terms on which a person is appointed to, or holds, an appointment in pursuance of section 9 of the Local Government and Housing Act 1989 (assistants for political groups) is that the annual rate of remuneration for the post is less than £13,500 or such other amount as the Secretary of State may specify by order.
This Order, which applies to relevant authorities in England only, provides for the annual rate of remuneration to be the maximum amount that is from time to time fixed by the National Joint Council for Local Government Services as that applicable to spinal column point 38 on their salary scales for local government officers.
The Local Government (Assistants for Political Groups) (Remuneration) (England) Order 2006 is revoked.
A full impact assessment has not been prepared for this instrument as no, or no significant impact on the private, voluntary or public sectors is foreseen.

The National Joint Council is the national negotiating body for pay and conditions in the local government sector, representing local government employers, their employees and local government trade unions.
The National Agreement on Pay and Conditions of Service is available on request from the Local Government Association.
