The Secretary of State makes these Regulations in exercise of the powers conferred by Article 62(2)(1) of Regulation (EU) No 1306/2013 of the European Parliament and of the Council on the financing, management and monitoring of the common agricultural policy, insofar as it applies to direct payments.
1.—(1) These Regulations may be cited as the Direct Payments to Farmers (Inspections) (England) Regulations 2021 and come into force on 8th October 2021.
(2) These Regulations extend to England and Wales and apply in England only.
2.—(1) Commission Implementing Regulation (EU) No 809/2014 laying down rules for the application of Regulation (EU) No 1306/2013 of the European Parliament and of the Council with regard to the integrated administration and control system, rural development measures and cross compliance(2) is amended insofar as it applies to direct payment schemes as follows.
(2) In Article 68(1), after the third sub-paragraph, insert the following sub-paragraph—
“For the purposes of checks in respect of claim year 2021, the first subparagraph applies as if for “1%” there were substituted “0.5%”.”.

These Regulations amend Commission Implementing Regulation (EU) No 809/2014 laying down rules for the application of Regulation (EU) No 1306/2013 of the European Parliament and of the Council with regard to the integrated administration and control system, rural development measures and cross compliance (EUR 2014/809) to reduce cross compliance inspection requirements for direct payment schemes in England for claim year 2021 from 1% to 0.5%. The amendment is made in consideration of the situation caused by the coronavirus. A similar change was made for claim year 2020.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on business, charities, voluntary bodies or the public sector is foreseen.
EUR 2013/1306, which was incorporated into domestic law in relation to direct payment schemes by the Direct Payments to Farmers (Legislative Continuity) Act 2020 (c. 2) and for remaining purposed by the European Union (Withdrawal) Act 2018 (c. 16). Article 62(2) was amended insofar as relating to direct payment schemes by regulation 7(4) of S.I. 2020/90. There are other amending instruments, including amendments to these provisions as they apply for other purposes, but none is relevant. Article 2(1)(m) defines “appropriate authority”.
EUR 2014/809, which was incorporated into domestic law in relation to direct payment schemes by the Direct Payments to Farmers (Legislative Continuity) Act 2020 (c. 2) and for remaining purposed by the European Union (Withdrawal) Act 2018 (c. 16). Article 68 was amended insofar as relating to direct payment schemes by S.I. 2020/90, 575, 1387 and 1513. There are other amending instruments, including amendments to these provisions as they apply for other purposes, but none is relevant.
