The Secretary of State for Health and Social Care, in exercise of the powers conferred by sections 176(1) and (2)(c) and 272(7) and (8) of the National Health Service Act 2006(1), makes the following Regulations.

Citation and commencement

1.  These Regulations may be cited as The National Health Service (Dental Charges) (Amendment) Regulations 2020 and come into force on 14th December 2020.

Amendment of the National Health Service (Dental Charges) Regulations 2005

2.—(1) The National Health Service (Dental Charges) Regulations 2005(2) are amended as follows.

(2) In regulation 4 (calculation of charges)—

(a)in paragraph (1), for “£22.70” substitute “£23.80”;

(b)in paragraph (2), for “£62.10” substitute “£65.20”;

(c)in paragraph (3), for “£269.30” substitute “£282.80”;

(d)in paragraph (4), for “£269.30” substitute “£282.80”; and

(e)in paragraph (5), for “£22.70” substitute “£23.80”.

(3) In regulation 12A (charges in respect of primary dental services provided under a prototype agreement), in paragraph (2) for “£22.70” substitute “£23.80”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the National Health Service (Dental Charges) Regulations 2005 (“the 2005 Regulations”).

The 2005 Regulations include the charges that are levied for NHS dental and orthodontic treatment in England. Regulation 2 amends regulation 4 of the 2005 Regulations to increase the charges for Band 1 courses of treatment from £22.70 to £23.80, Band 2 courses of treatment from £62.10 to £65.20 and Band 3 courses of treatment from £269.30 to £282.80. Regulation 2 also amends regulation 12A of the 2005 Regulations to increase the charge for a Band 1A interim care course of treatment provided by contractors participating in the Prototype Agreement Scheme, from £22.70 to £23.80, in line with the Band 1 charge.

An assessment of the impact of this instrument has been made. A copy of this impact assessment is annexed to the Explanatory Memorandum which is available alongside this instrument on the legislation.gov.uk website. 2006 c.41. Section 176 was amended by section 55(1) of, and paragraph 94 of Schedule 4, to the Health and Social Care Act 2012 (c. 7). By virtue of section 271(1) the National Health Service Act (“the 2006 Act”), the powers being exercised by the Secretary of State in the making of these Regulations are exercisable only in relation to England. See section 275(1) of the 2006 Act for the definitions of “prescribed” and “regulations” that are relevant to the powers being exercised.
