2.—(1) Regulation 2 of the Principal Regulations (interpretation) is amended as follows.
(2) Omit the definition of “relevant NHS body”.
(3) At the appropriate places, insert—
““actual charge” has the meaning given in regulation 3(7);
“advance payment sum” has the meaning given in regulation 3(7);”;
““relevant body” means—
an NHS foundation trust;
an NHS trust;
a local authority within the meaning of section 2B of the 2006 Act(1) (functions of local authorities and Secretary of State as to improvement of public health) exercising public health functions (within the meaning of that Act(2)); or
any other person providing relevant services,
except in respect of regulation 6A, for which purposes a person mentioned in paragraph (d) is not a “relevant body”;.”.
2006 c.41. Section 2B was inserted by section 12 of the Health and Social Care Act 2012 (c.7).
The meaning of a reference to the public health functions of local authorities is given by section 1H(5)(b) of the National Health Service Act 2006 (c. 41), which was inserted by section 9(1) of the Health and Social Care Act 2012.
