The Queen’s Most Excellent Majesty in Council

Her Majesty, in pursuance of section 22 of, and paragraph 4(1)(a) of Schedule 3 to the Charities Act 2011(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order may be cited as the Exempt Charities (No. 2) Order 2016 and shall come into force on 1st August 2016.E+W

2.  University of Suffolk is hereby declared to be an exempt charity for the purposes of the Charities Act 2011.E+W

EXPLANATORY NOTE

(This note is not part of the Order)

This Order declares University of Suffolk to be an exempt charity within the meaning of the Charities Act 2011 with effect from 1st August 2016. An exempt charity cannot be registered with the Charity Commission and the Commission cannot exercise any powers under the Act in relation to an exempt charity except:

it may exercise advisory and permissive powers at the charity’s request, following consultation with any principal regulator appointed under the Charities Act 2011;

ii) it may open a statutory inquiry and use powers to act for the protection of charities at the invitation of any principal regulator appointed under the Charities Act.

The Higher Education Funding Council for England (HEFCE) has been appointed principal regulator for exempt universities and Higher Education Institutions in England, and automatically becomes principal regulator for the University of Suffolk.
