The Secretary of State makes the following Order in exercise of the powers conferred by sections 1(1) and 18(2) of the Safety of Sports Grounds Act 1975(1).

In accordance with section 18(4) of that Act, he has consulted with such persons or bodies of persons as appear to him to be requisite.

Title, commencement and interpretation

1.—(1) The title of this Order is the Safety of Sports Grounds (Designation) Order 2015, and it comes into force on 1st October 2015.

(2) In this Order, “the Act” means the Safety of Sports Grounds Act 1975.

Designations

2.—(1) The sports grounds specified in Schedule 1 to this Order, being sports grounds which in the opinion of the Secretary of State have accommodation for more than 10,000 spectators, are designated as sports grounds requiring a safety certificate under the Act.

(2) The sports grounds specified in Schedule 2 to this Order, being sports grounds—

(a)in England and Wales,

(b)at which association football matches are played,

(c)which are occupied by a club that is a member of the Football League Limited or the Football Association Premier League Limited, and

(d)which in the opinion of the Secretary of State have accommodation for more than 5,000 spectators,

are designated as sports grounds requiring a safety certificate under the Act(2).

Revocations

3.  The Orders listed in Schedule 3 to this Order are revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

By section 1 of the Safety of Sports Grounds Act 1975, the Secretary of State may by order designate as a sports ground requiring a safety certificate under that Act any sports ground which, in his opinion, has accommodation for more than the specified number of spectators.

By the Safety of Sports Grounds (Accommodation of Spectators) Order 1996 (S.I. 1996/499), the specified number of spectators is 5,000 for sports grounds in England and Wales at which association football matches are played and which are occupied by a club that is a member of the Football League Limited or the Football Association Premier League Limited. The specified number of spectators for all other purposes is 10,000.

Article 2 of and Schedules 1 and 2 to this Order consolidate, with amendments, the large number of designations made in respect of sports grounds in England and Wales by orders previously made under section 1 of the Act.

Article 3 of and Schedule 3 to this Order revoke all previous designation orders relating to sports grounds in England and Wales. Any sports ground designated in a previous order as requiring a safety certificate is omitted from this Order if such a certificate is no longer required because that sports ground no longer meets the conditions to which the Secretary of State’s power to designate is subject.

An impact assessment has not been produced for this Order, as no impact on the private, voluntary or public sectors is foreseen. An Explanatory Memorandum has been prepared and is available alongside this instrument on www.legislation.gov.uk.

1975 c. 52; section 1(1) was amended by Schedule 2 to the Fire Safety and Safety of Places of Sport Act 1987 (c. 27). The functions of the Secretary of State were, so far as exercisable in relation to Scotland, transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).

For the number specified in section 1(1) of the Safety of Sports Grounds Act 1975 (currently 10,000), the Safety of Sports Grounds (Accommodation of Spectators) Order 1996 (S.I. 1996/499) substituted the number 5,000 in respect of a sports ground in England and Wales at which association football matches are played and which is occupied by a club which is a member of either the Football League Limited or the Football Association Premier League Limited.

Explanatory Memorandum

Explanatory Memorandum sets out a brief statement of the purpose of a Statutory Instrument and provides information about its policy objective and policy implications. They aim to make the Statutory Instrument accessible to readers who are not legally qualified and accompany any Statutory Instrument or Draft Statutory Instrument laid before Parliament from June 2004 onwards.
