An application has been made to the Secretary of State under paragraph 2 of Schedule 6 to the Planning Act 2008(1) (“the 2008 Act”) and in accordance with Part 1 of the Infrastructure Planning (Changes to, and Revocation of, Development Consent Orders) Regulations 2011(2) (“the 2011 Regulations”) for a non-material change to the Lancashire County Council (Torrisholme to the M6 Link (A683 Completion of Heysham to M6 Link Road)) Order 2013(3).

The Secretary of State, having considered the application and the responses to consultation under regulation 7 of the 2011 Regulations has determined to make an Order giving effect to the proposals comprised in the application which in the opinion of the Secretary of State do not make any material change to the Lancashire County Council (Torrisholme to the M6 Link (A683 Completion of Heysham to M6 Link Road)) Order 2013.

The Secretary of State, in exercise of the powers conferred by section 153 of, and paragraph 2 of Schedule 6 to, the 2008 Act, makes the following Order—

Citation and commencement

1.  This Order may be cited as the Lancashire County Council (Torrisholme to the M6 Link (A683 Completion of Heysham to M6 Link Road)) (Amendment) Order 2015 and comes into force on 26th March 2015.

Interpretation

2.  In this Order—

“the 2013 Order” means the Lancashire County Council (Torrisholme to the M6 Link (A683 Completion of Heysham to M6 Link Road)) Order 2013;

“the revised plans and sections” means the plans and sections certified by the Secretary of State as the revised plans and sections for the purposes of this Order; and

“the 2013 plans and sections” means the plans and sections certified by the Secretary of State for the purposes of the 2013 Order.

Amendment to the 2013 Order

3.  The 2013 Order is amended as follows.

4.  In Work No. 1 of Schedule 1 (authorised development)—

(a) in paragraph (xxviii) omit “, and the installation of Long Bank Wood Retaining Wall to protect a diverted gas transmission pipeline”; and

(b) omit paragraph (xxxi) (diversion of gas transmission pipeline).

5.  In paragraph 23 (gas main diversion) of Schedule 2 (requirements) for “works Nos.1 (xxii) and 1 (xxxi) have”, substitute “work No. 1 (xxii) has”.

Revised plans and sections

6.—(1) The revised plans and sections listed in column (2) of the Schedule (revised plans) are to replace the 2013 plans and sections set out in column (1).

(2) Any references to plans or sections in the 2013 Order are to be taken to be references to those plans or sections as revised by this Order.

Certification of plans, etc.

7.—(1) Lancashire County Council must, as soon as practicable after the making of this Order, submit copies of the revised plans and sections to the Secretary of State for certification that they are true copies of the revised plans and sections.

(2) A plan or a document so certified is admissible in any proceedings as evidence of the contents of the document of which it is a copy.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Lancashire County Council (Torrisholme to the M6 Link (A683 Completion of Heysham to M6 Link Road)) Order 2013 to enable Lancashire County Council to realign the northbound diverge slip road at junction 34 of the M6 motorway to avoid a gas pipeline restricted area and to make it unnecessary to divert the gas pipeline.

A copy of the revised plans mentioned in this Order and certified in accordance with article 7 (certification of plans, etc.) of this Order, may be inspected free of charge during working hours at Lancashire County Council offices, County Hall, Fishergate, Preston, PR1 8XJ.
