Amendment of the Child Support (Maintenance Assessments and Special Cases) Regulations 1992

13.—(1) The Child Support (Maintenance Assessments and Special Cases) Regulations 1992(1) are amended as follows.

(2) In Schedule 2 (amounts to be disregarded when calculating or estimating n and m)—

(a)for paragraph 8 substitute—

“8.  Any disability living allowance, personal independence payment, mobility supplement or any payment intended to compensate for the non-payment of any such allowance, payment or supplement.”; and

(b)in paragraph 15(2) after “disability living allowance,” insert “personal independence payment,”.

(3) In Schedule 4 (cases where child support maintenance is not to be payable)—

(a)omit “and” at the end of paragraph (b)(x)(3); and

(b)after paragraph (c) insert—

“; and

(d)personal independence payment in accordance with Part 4 of the Welfare Reform Act 2012”.

There are amendments to paragraph 15 which are not relevant to these Regulations.
