1. This Order may be cited as the National Lottery etc. Act 1993 (Amendment of Section 23) Order 2011 and shall come into force on 1st April 2011.
2. Section 23(1)(e)(3) of the National Lottery etc. Act 1993 (distributing bodies for sums allocated for expenditure on or connected with the arts) is amended by substituting “The British Film Institute” for “the UK Film Council”.
3. Sums that apart from this Order would be held in the Distribution Fund for distribution by the UK Film Council shall be held in the Distribution Fund for distribution by The British Film Institute.

Section 23 of the National Lottery etc. Act 1993 (“the 1993 Act”) specifies the bodies that are to distribute sums paid into the National Lottery Distribution Fund. Subsection (1) of section 23 of the 1993 Act deals with sums paid into that Fund that are allocated for expenditure on or connected with the arts. Article 2 of this Order amends subsection 23(1)(e) of the 1993 Act by substituting The British Film Institute for the UK Film Council. The British Film Institute is an incorporated body established by Royal Charter.
Article 3 of this Order transfers the balances of the UK Film Council in the National Lottery Distribution Fund to The British Film Institute.
Section 29 of the National Lottery etc. Act 1993 (c. 39) (“the 1993 Act”) was amended by the Scotland Act 1998 (Modification of Functions) Order 1999 (S.I. 1999/1756), article 2 and paragraph 15(5) of the Schedule. In addition, by virtue of the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 1999 (S.I. 1999/1750), article 2 and Schedule 1, the functions conferred on the Secretary of State by section 29 of the 1993 Act are, so far as they are exercisable in or as regards Scotland, exercisable by the Scottish Ministers only with the agreement of the Secretary of State.
Section 60 of the 1993 Act was amended by section 15 of the National Lottery Act 1998 (c. 22) and sections 8 and 19 of the National Lottery Act 2006 (c. 23).
Section 23 of the 1993 Act has been amended by S.I. 1994/1342, S.I. 1996/3095, S.I. 1999/1563, S.I. 1999/2090, S.S.I. 2000/78, S.I. 2006/654, S.I. 2007/743 and S.S.I. 2010/223.
