CHAPTER 2 E+W MAXIMUM AMOUNTS OF LOANS

General E+W

71.—(1) The maximum amount of a loan for living costs in respect of an academic year is calculated as follows—

(a) where the eligible student is a 2008 cohort student with full entitlement, in accordance with regulation 72 or 73;

(b) where the eligible student is a 2009 cohort student with full entitlement, in accordance with regulation 74 or 75;

(c) where the eligible student is a 2012 cohort student with full entitlement, in accordance with regulation 76;

(d) where the eligible student is a current system student [F1 (other than a 2008, 2009, 2012 or 2016 cohort student)] with full entitlement, in accordance with regulation 77 or 78;

(e) where the eligible student is an old system student with full entitlement, in accordance with regulation 79;

(f) where the eligible student is a student with reduced entitlement, in accordance with regulation 80 [F2 ;]

[F3 (g) in accordance with regulation 80A where the eligible student—

(i) is a 2016 cohort student with full entitlement;

(ii) is under the age of 60 on the relevant date; and

(iii) does not meet the condition in sub-paragraph (h)(iii);

(h) in accordance with regulation 80B where the eligible student—

(i) is a 2016 cohort student with full entitlement;

(ii) is under the age of 60 on the relevant date; and

(iii) would qualify for a special support grant but for regulation 61(A1);

(i) in accordance with regulation 80C where the eligible student—

(i) is a 2016 cohort student with full entitlement; and

(ii) is not under the age of 60 on the relevant date.]

2008 cohort students with full entitlement F5 ... E+W

72.—(1) This regulation applies to a 2008 cohort student with full entitlement F6 ....

(2) Subject to Chapter 4 of this Part and paragraph (5), where the student's household income exceeds £61,062 the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year other than the final year of a course that is not an intensive course is equal to where—

• X is—

  (i)

  for a student in category A, [F7 £4,163];

  (ii)

  for a student in category B, [F8 £7,533];

  (iii)

  for a student in category C, [F9 £6,409];

  (iv)

  for a student in category D, [F10 £5,380];

• Subject to paragraph (4), Y is £1 for every complete [F11 £8.17] by which the household income exceeds £61,062.

(3) Subject to Chapter 4 of this Part and paragraph (5), where the student's household income exceeds £61,062, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year that is the final year of a course that is not an intensive course is equal to where—

• X is—

  (i)

  for a student in category A, [F12 £3,762];

  (ii)

  for a student in category B, [F13 £6,858];

  (iii)

  for a student in category C, [F14 £5,572];

  (iv)

  for a student in category D, [F15 £4,977];

• Subject to paragraph (4), Y is £1 for every complete [F16 £8.17] by which the household income exceeds £61,062.

(4) Where the same household income is used to assess the amount of a statutory award for which two or more persons qualify, Y in paragraphs (2) and (3) must be divided by the number of such persons before being deducted from X.

(5) Where the maximum amount of loan for living costs is calculated in accordance with paragraph (2) or (3) and is less than the minimum level for the academic year specified in regulation 105, the minimum level for the academic year is payable.

(6) Subject to Chapter 4 of this Part, where the student's household income exceeds [F17 £61,047] but does not exceed £61,062, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year other than the final year of a course that is not an intensive course is—

(a) for a student in category A, [F18 £4,163];

(b) for a student in category B, [F19 £7,533];

(c) for a student in category C, [F20 £6,409];

(d) for a student in category D, [F21 £5,380].

(7) Subject to Chapter 4 of this Part, where the student's household income exceeds [F22 £61,047] but does not exceed £61,062, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year that is the final year of a course that is not an intensive course is—

(a) for a student in category A, [F23 £3,762];

(b) for a student in category B, [F24 £6,858];

(c) for a student in category C, [F25 £5,572];

(d) for a student in category D, [F26 £4,977].

(8) Subject to Chapter 4 of this Part, where the student's household income is [F27 £61,047] or less, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year other than the final year of a course that is not an intensive course is equal to where—

• X is—

  (i)

  for a student in category A, [F28 £4,163];

  (ii)

  for a student in category B, [F29 £7,533];

  (iii)

  for a student in category C, [F30 £6,409];

  (iv)

  for a student in category D, [F31 £5,380];

• Y is the maintenance grant amount.

(9) Subject to Chapter 4 of this Part, where the student's household income is [F32 £61,047] or less, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year that is the final year of a course that is not an intensive course is equal to where—

• X is—

  (i)

  for a student in category A, [F33 £3,762];

  (ii)

  for a student in category B, [F34 £6,858];

  (iii)

  for a student in category C, [F35 £5,572];

(7) Subject to Chapter 4 of this Part, where the student's household income exceeds [F55 £50,706] but does not exceed £50,778, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year that is the final year of a course that is not an intensive course is—

(a) for a student in category A, [F56 £3,948];

(b) for a student in category B, [F57 £7,152];

(c) for a student in category C, [F58 £5,810];

(d) for a student in category D, [F59 £5,195].

(8) Subject to Chapter 4 of this Part, where the student's household income is [F60 £50,706] or less, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year other than the final year of a course that is not an intensive course is equal to X–Y where—

• X is—

  (i)

  for a student in category A, [F61 £4,352];

  (ii)

  for a student in category B, [F62 £7,855];

  (iii)

  for a student in category C, [F63 £6,682];

  (iv)

  for a student in category D, [F64 £5,614];

• Y is the maintenance grant amount.

(9) Subject to Chapter 4 of this Part, where the student's household income is [F65 £50,706] or less, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year that is the final year of a course that is not an intensive course is equal to where—

• X is—

  (i)

  for a student in category A, [F66 £3,948];

  (ii)

  for a student in category B, [F67 £7,152];

  (iii)

  for a student in category C, [F68 £5,810];

  (iv)

  for a student in category D, [F69 £5,195];

• Y is the maintenance grant amount.

(10) In this regulation, the “maintenance grant amount” is—

(a) where the student F70 ... qualifies under Chapter 6 of Part 5 for a maintenance grant, half the amount of the maintenance grant payable; [F71 and]

  for a student in category D, £1 for every complete [F199 £5.133] by which the student’s household income exceeds £25,000 but does not exceed £42,875;

• Z is—

  (i)

  for a student in category A, £1 for every complete [F196 £8.10] by which the student’s household income exceeds £42,875;

  (ii)

  for a student in category B, £1 for every complete [F197 £7.87] by which the student’s household income exceeds £42,875;

  (iii)

  for a student in category C, £1 for every complete [F198 £7.93] by which the student’s household income exceeds £42,875;

  (iv)

  for a student in category D, £1 for every complete [F199 £8.01] by which the student’s household income exceeds £42,875.

(5) The loan for living costs for an academic year that is the final year of a course that is not an intensive course, where regulation 71(1)(h) applies, is made up of a loan for maintenance and a special support loan, whereby the maximum loan for maintenance is—

(a) for a student in category A, [F200 £4,557];

(b) for a student in category B, [F201 £7,924];

(c) for a student in category C, [F202 £6,439];

(d) for a student in category D, [F203 £5,799];

and any remainder is a special support loan.

(6) Where the maximum amount of loan for living costs is calculated in accordance with paragraph (2) or (4) and is less than the minimum level for the academic year specified in regulation 105, the minimum level for the academic year is payable.]

[F179 2016 cohort students with full entitlement who satisfy the conditions in regulation 71(1)(i) E+W

80C.— (1) This regulation applies to a 2016 cohort student who satisfies both the conditions in regulation 71(1)(i).

(2) Subject to Chapter 4 of this Part, the loan for living costs is a special support loan and the maximum amount for which a student to whom this regulation applies qualifies is equal to—

where—

• X is [F204 £3,680];

• Y is £1 for every complete [F204 £5.15] by which the student’s household income exceeds £25,000.

(3) Where the amount of loan for living costs calculated under paragraph (2) is less than £50, the amount of loan for living costs payable is nil.]
