This instrument revokes the Education (Schools and Further and Higher Education) Regulations 1989 thereby removing the requirement for maintained schools and non-maintained special schools to obtain the Secretary of State’s approval before using for the purposes of instruction certain radioactive substances and certain apparatus in which electrons are accelerated by a potential difference of at least 5 kilovolts (regulation 2). It also removes the requirement for independent schools approved under section 347 of the Education Act 1996 to notify the Secretary of State in writing before using such substances and apparatus for the purposes of instruction (regulation 3).
A full impact assessment has not been produced for this instrument as it has only a negligible impact on the private and voluntary sectors.
