EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations substitute references to the European Communities (Recognition of Professional Qualifications) Regulations 2007 (S.I. 2007/2781)) (the 2007 Regulations) for references to Council Directive 89/48/EEC in the Education (Induction Arrangements for School Teachers) (Consolidation) (England) Regulations 2001 (S.I. 2001/2897, as amended by S.I. 2003/106) and the Education (School Teachers’ Qualifications) (England) Regulations 2003 (S.I. 2003/1662) (regulations 3 and 4).

They also amend the Education (Specified Work and Registration) (England) Regulations 2003 (S.I. 2003/1663, as amended by S.I. 2007/2117) to exempt qualified teachers who, as respects the profession of school teacher, fall within the 2007 Regulations from the requirement to be registered with full registration with the General Teaching Council for England if they only carry out specified work in a school on a temporary or occasional basis (regulation 5).

The 2007 Regulations implement Directive 2005/36/EC of the European Parliament and of the Council on the recognition of professional qualifications. That Directive replaces and combines into a single text Council Directives 89/48/EEC and 92/51/EEC and Directive 1999/42/EC of the European Parliament and of the Council on the general system for the recognition of professional qualifications and twelve related Council Directives concerning particular professions.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
