Explanatory Note

This Order, which comes into force on 10th April 2006, amends the Football Spectators (Prescription) Order 2004 (“the 2004 Order”) by prescribing additional matches for the purposes of Part II of the Football Spectators Act 1989 (“regulated matches”).

Paragraph (2) of article 2 adds to those football matches which are regulated matches in England and Wales, any match in which a participating team represents a club from outside England and Wales.

Paragraph 3 makes two additions to those football matches which are regulated outside England and Wales. The first is any match involving a country or territory whose football association is a member of the Federation Internationale de Football Associations (“FIFA”), where the match is part of a competition or tournament organised by or under the authority of FIFA or the Union des Associations Europeennes de Football (“UEFA”), and where the competition or tournament is one in which the England or Wales national team is eligible to participate or has participated.

The second addition is any match involving a club whose national football association is a member of FIFA, where the match is part of a competition or tournament organised by or under the authority of FIFA or UEFA, and where the competition or tournament is one in which a club from the Football League, the Football Association Premier League, the Football Conference or the League of Wales is eligible to participate or has participated.

It is an offence under section 166 of the Criminal Justice and Public Order Act 1994 for an unauthorised person to sell, offer or expose for sale, a ticket for a regulated match in a public place, or a place to which the public have access, or in the course of a trade or business. The effect of a banning order under the Football Spectators Act 1989 is that the individual concerned is prohibited from attending regulated matches in England and Wales and must report to a police station when required to do so on the occasion of regulated matches outside England and Wales.
