The Secretary of State for Health, in exercise of the powers conferred upon him by sections 28D(1)(bc), 28R, 28S, 28V, 28W, 45A(9) and 126(4) of the National Health Service Act 1977(1), section 4(5) of the National Health Service and Community Care Act 1990(2) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1977 c. 49; section 28D(1)(bc) was inserted by section 177(2) of the Health and Social Care (Community Health and Standards) Act 2003 (c. 43) (“the 2003 Act”); sections 28R, 28S, 28V and 28W were inserted by section 175(1) of that Act and section 45A by paragraph 23 of Schedule 11 to that Act.
