Explanatory Note

These Regulations amend the International Carriage of Dangerous Goods by Road (Fees) Regulations 1988 (“the 1988 Regulations”).

Regulation 2 makes the following amendments to the fees prescribed by the 1988 Regulations. An “ADR certificate” is a special certificate of approval as defined in regulation 2 of the 1988 Regulations. “ADR” is the acronym for “Accord European Relatif au Transports International des Marchandises Dangereuses par Route”.

(a)The fee payable where a first inspection in relation to an application for an ADR certificate is carried out on the same day as an examination under the Goods Vehicles (Plating and Testing) Regulations 1988, is increased by 2.9% from £68 to £70. The fee for a first inspection in any other case is increased by 2.9% from £68 to £70 plus the amount which would be payable in respect of an examination under those Regulations.

(b)Where a vehicle fails to pass an inspection and arrangements are made for a further inspection to be carried out not more than 14 days after the first inspection, the additional fee payable is increased by 2.9% from £34 to £35.

Regulation 3 amends regulation 8(3) of the 1988 Regulations by providing for the return to the applicant of any sum paid by him in respect of an application for an ADR certificate where he does not make an application for another inspection in accordance with regulation 8(2) of the 1988 Regulations.

A regulatory impact assessment has been prepared and copies can be obtained from the Department for Transport, Zone 2/05, Great Minster House, 76 Marsham Street, London SW1P 4DR (telephone number: 020–7944 2455). A copy has been placed in the library of each House of Parliament.
