Whereas—

(1) the further education corporation known as North Derbyshire Tertiary College (“the corporation”) shall be dissolved on 31st December 2002 in accordance with the North Derbyshire Tertiary College (Dissolution) Order 2002(1) (“the dissolution order”);

(2) section 26 of the Further and Higher Education Act 1992(2) (“the Act”) was modified by the dissolution order in its application to the corporation;

(3) section 26 (1) to (5) of the Act as so modified applies to any person employed by the corporation immediately before 31st December 2002 to work at North Derbyshire Tertiary College, where that person is designated for the purposes of that section by an Order made by the Secretary of State:

Now therefore, in exercise of the powers conferred upon him by section 26 (1) to (5) of the Act as modified by the dissolution order the Secretary of State for Education and Skills hereby makes the following Order:

1.  This Order may be cited as the North Derbyshire Tertiary College (Designated Staff) Order 2002 and shall come into force on 31st December 2002.

2.  Those persons employed by the corporation immediately before 31st December 2002 to work at North Derbyshire Tertiary College who are named in Parts I, II, III or IV of the Schedule to this Order are hereby designated for the purposes of section 26 of the Act.

3.  The references to the corporation in section 26 (2) and (3) of the Act are references to—

(a)Chesterfield College in the case of those persons who are named in Part I of the Schedule to this Order;

(b)North Nottinghamshire College in the case of those persons who are named in Part II of the Schedule to this Order;

(c)The Derbyshire County Council in the case of those persons who are named in Part III of the Schedule to this Order;

(d)Chesterfield College in the case of those persons who—

(i)are named in Part IV of the Schedule to this Order and

(ii)were employed by the corporation immediately before 31st December 2002 to work at the Clowne College premises of the North Derbyshire Tertiary College;

(e)North Nottinghamshire College in the case of those persons who—

(i)are named in Part IV of the Schedule to this Order and

(ii)were employed by the corporation immediately before 31st December 2002 to work at The Community Learning Opportunity Centre at Kiveton and Wales premises of the North Derbyshire Tertiary College;

(f)The Derbyshire County Council in the case of those persons who—

(i)are named in Part IV of the Schedule to this Order and

(ii)were employed by the corporation immediately before 31st December 2002 to work at the Manor College Chesterfield premises of the North Derbyshire Tertiary College.

Explanatory Note

(This note is not part of the Order)

This Order designates for the purposes of section 26 of the Further and Higher Education Act 1992 certain staff who are employed by the North Derbyshire Tertiary College to work at that college immediately before 31st December 2002. These are the staff named in Parts I, II, III or IV of the Schedule to this Order.

31st December 2002 is the date on which the corporation established to conduct North Derbyshire Tertiary College is to be dissolved under section 27 of that Act. On that date, all the corporation’s property, rights and liabilities will transfer to other bodies.

In designating these staff, the Order provides for the protection of their employment rights. It does so by applying section 26 (2) to (5) of the 1992 Act and a modified section 26 (1) of that Act.

The contracts of employment of the designated staff will pass to one of either Chesterfield College, North Nottinghamshire College or The Derbyshire County Council.

Part I of the Schedule lists the names of those employees whose contracts of employment will pass to Chesterfield College. Part II of the Schedule lists the names of those employees whose contracts of employment will pass to the North Nottinghamshire College. Part III of the Schedule lists the names of those employees whose contracts of employment will pass to The Derbyshire County Council.

Part IV of the Schedule lists the names of those employees who have more than one contract of employment with the North Derbyshire Tertiary College. On dissolution, each contract of employment will pass to one of either Chesterfield College, North Nottinghamshire College or The Derbyshire County Council.
