The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred by section 96(10) of the Transport Act 1968(1) (“the Act”) and now vested in him(2), and of all other powers enabling him in that behalf, after consultation with representative organisations in accordance with section 101(6) of the Act, hereby makes the following Regulations:

1.  These Regulations may be cited as the Drivers' Hours (Goods Vehicles) (Milk Collection) (Temporary Exemption) (Revocation) Regulations 2001 and shall come into force on 31st December 2001.

2.  The Drivers' Hours (Goods Vehicles) (Milk Collection) (Temporary Exemption) Regulations 2001(3) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations revoke the Drivers' Hours (Goods Vehicles) (Milk Collection) (Temporary Exemption) Regulations 2001 (“the principal Regulations”) (S.I. 2001/629).

The principal Regulations extended the permissible maximum working day of a driver engaged in the collection and transportation of milk to meet the special needs occasioned by the outbreak of foot-and-mouth disease in Great Britain, or the effects or consequences of such outbreak.

The working day of a driver, as set out in section 96(3)(a) of the Transport Act 1968 (“the 1968 Act”), was extended by the principal Regulations from a maximum of eleven to thirteen hours.

The effect of these Regulations is to restore the maximum working day as prescribed by the 1968 Act.
