The President of the Council, having been designated by the Treasury as having responsibility for the public service pension schemes referred to in article 2, in exercise of the powers conferred by section 27(3) of the Welfare Reform and Pensions Act 1999(1), hereby makes the following Order:
1. This Order may be cited as the Pension Sharing (Excepted Schemes) Order 2001 and shall come into force on 5th March 2001.
2. The public service pension schemes relating to the following offices are excepted:
Prime Minister and First Lord of the Treasury;
Lord Chancellor; and
Speaker of the House of Commons.
3. The Pension Sharing (Excepted Schemes) Order 2000 is revoked(2).

This Order is made in consequence of a defect in the Pension Sharing (Excepted Schemes) Order 2000 which this Order revokes and replaces. This Order will be issued free of charge to all known recipients of the Pension Sharing (Excepted Schemes) Order 2000.
This Order excepts the public service pension schemes relating to the office of the Prime Minister and First Lord of the Treasury, Lord Chancellor and Speaker of the House of Commons for the purposes of section 27(1) of the Welfare Reform and Pensions Act 1999. Section 27(1) makes provision for pension sharing other than in relation to an excepted public service pension scheme.
