Whereas a draft of these Regulations has been laid before Parliament for a period of forty days pursuant to section 6 of the Statutory Instruments Act 1946(1), and that period has expired without either House resolving that the Regulations be not made:
Now, therefore, in exercise of the powers conferred by section 2(1) of the Parks Regulation (Amendment) Act 1926(2) as extended by section 7(5) of the Crown Estate Act 1961(3) and by section 1(1) of the Royal Parks (Trading) Act 2000 and now vested in him(4), the Secretary of State hereby makes the following Regulations:—
1. These Regulations may be cited as the Royal Parks and Other Open Spaces (Park Trading) Regulations 2000 and shall come into force the day after the day on which they are made.
2. In the Royal Parks and Other Open Spaces Regulations 1997(5) after regulation 6 there shall be inserted—
“6A. Regulation 4(6) above is a park trading regulation within the meaning of section 1 of the Royal Parks (Trading) Act 2000(6) (designation of regulations as park trading regulations).”

Section 1(1) of the Royal Parks (Trading) Act 2000 allows the Secretary of State for Culture, Media and Sport, as one of the successors to the Commissioners of Works, to designate particular provisions of any regulations made under section 2(1) of the Parks Regulation (Amendment) Act 1926, as “park trading regulations”. These regulations achieve that designation.
Any failure to comply with a park trading regulation is designated as a “park trading offence” by section 1(2) of the Royal Parks (Trading) Act 2000 and the powers provided by that Act may be used in relation to a park trading offence.
