The Local Government Act 1988 (Defined Activities) (Exemptions) (Scotland) Order 1997

Interpretation

2.—(1) In this Order–

“the Act” means the Local Government Act 1988;

“specified activity” means (subject to paragraph (2) below) a defined activity listed in section 2(2)(a), (b), (c), (d), (e), (ee), (f), (g), (gg) or (i) of the Act(1).

(2) For the purposes of article 3 below, the defined activity listed in paragraph (b) of section 2(2) of the Act shall exclude–

(a) work falling within that paragraph which is carried out by the Dumfries and Galloway Council or the Fife Council; and

(b) work falling within that paragraph by reason only of article 3(1) of the Local Government Act 1988 (Competition) (Defined Activities) Order 1995(2) which is carried out by a joint board.
