Explanatory Note

(This note is not part of the Order)

This Order, which is made under section 3 of the Transport and Works Act 1992, empowers the London Borough of Barking and Dagenham to construct a semi-tidal barrage with moveable control gates across the River Roding and to execute ancillary works, including dredging of the upstream river. The Order confers the necessary powers on the Borough, including powers to acquire the requisite land and rights by agreement or compulsorily.

  • Other matters contained in the Order include—

    (a)

    provisions to ensure that the safeguards of sections 25 and 109 of the Water Resources Act 1991, section 76 of the Port of London Act 1968 and section 9 of the Salmon and Freshwater Fisheries Act 1975, which are disapplied by the Order, are met, together with provisions for deemed licence or consent under sections 66 and 73 of the Port of London Act 1968 and Thames Water Land Drainage Byelaws 1981;

    (b)

    provisions for closing the river to navigation temporarily during the construction of the works and for recreational purposes;

    (c)

    provisions for the safety of navigation;

    (d)

    provisions for the operation of the barrage and for the making of byelaws; and

    (e)

    provisions protecting the interests of various interested bodies.
