CHANGES IN LOCAL GOVERNMENT AREAS

The Cheshire, Lancashire and Merseyside (County Boundaries) Order 1993

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Cheshire, Lancashire and Merseyside (County Boundaries) Order 1993.

(2) This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976(2).

(3) For all other purposes, this Order shall come into force on 1st April 1994.

Interpretation

2.  In this Order—

“Cheshire” means the county of Cheshire;

“district” includes a borough and a metropolitan borough;

“electoral division” means an electoral division of the county to which an area is transferred by this order; any reference to Halton or to Warrington is a reference to the Cheshire district of that name;

“Lancashire” means the county of Lancashire, except in the expression “West Lancashire”, where it means the district of that name in that county;

“the map” means one of the 5 maps prepared by the Department of the Environment, marked “Maps of the Cheshire, Lancashire and Merseyside (County Boundaries) Order 1993”, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

“Merseyside” means the metropolitan county of Merseyside, and any reference to St.Helens is a reference to the district of that name in that county; any reference to an area as unparished is a reference to that area not forming part of any parish; and

“ward” means a ward of the district from or to which an area is transferred.

Transfers from Cheshire (Warrington) to Merseyside (St. Helens)

3.  Each area which is marked as shown in column 1 of the following Table on the Map indicated in column 2 shall be transferred from Cheshire, from Warrington and from the parish named in column 3 to—

(a)Merseyside;

(b)St. Helens;

(c)the parish (if any) and ward mentioned in column 4; and to

(d)the St. Helens petty sessional division and the Knowsley, St. Helens and Sefton coroner’s district.

4.  Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Merseyside, from St. Helens, and from the parish named in column 3 to—

(a)Cheshire;

(b)Halton;

(c)the ward and electoral division mentioned in column 4; and to

(d)the Halton petty sessional division and the Cheshire coroner’s district— and shall become unparished. Table Area marked—

5.  Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Merseyside, from St. Helens, and from the parish (or, where unparished, the ward) named in column 3 to—

(a)Cheshire;

(b)Warrington;

(c)the parish, ward and electoral division mentioned in column 4; and to

(d)the Warrington petty sessional division and the Cheshire coroner’s district.

Transfer from Lancashire (West Lancashire) to Merseyside (St. Helens)

6.  The area which is marked A on map 1 shall be transferred from Lancashire, from West Lancashire, and from the parish of Bickerstaffe to—

(a)Merseyside;

(b)St. Helens;

(c)the parish of Rainford;

(d)the Rainford ward; and to

(e)the St. Helens petty sessional division and the Knowsley, St. Helens and Sefton coroner’s district.

Town and country planning

7.—(1) In this article, “provision” means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990(3)).

(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

Explanatory Note

(This note is not part of the Order)

This Order makes alterations to county boundaries in the vicinity of the metropolitan borough of St. Helens in Merseyside. Areas are transferred from Cheshire (Warrington) to St. Helens, and from St. Helens to Cheshire (Halton and Warrington). One small change is also made in the boundary between St. Helens and Lancashire (West Lancashire).

The map and table forming part of this note (Pages 4, 5 and 6) give a general guide to the areas affected, and their approximate size and population. Prints of the detailed maps (described in article 2) may be inspected at all reasonable times at the offices of the council for each borough or district affected, and additionally at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.

The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as this one.

TABLE SHOWING CHANGES EFFECTED

Transfers from Cheshire (Warrington) to Merseyside (St. Helens)—

Article 2

Open land located north-west of Burtonwood Airfield and south-east of Moat House Farm, including part of M62 motorway.

Transfers from Merseyside (St. Helens) to Cheshire (Halton)—

Article 4

Total area: 260 hectares

Population: 120

Transfer of—

1.  Large area stretching from Wilmore Lane eastwards to the junction of Mill Green Lane and Farnworth Road, including Wilmore House, Bank Head, Cranshaw Hall, Mill Green Farm and part of Lunt’s Bridge Farm.

2.  Area located to the south of Old South Lane and Farnsworth Road and to the north of Barrows Green, including Knight’s House Farm, Boundary Farm and part of the railway line near Widnes East Junction.

3.  Area running eastwards from the A540 road (in the vicinity of Norland’s Lane), and including Sandhill Farm, Harefield Farm and Rainhill Place Farm.

Transfers from Merseyside (St. Helens) to Cheshire (Warrington)—

  • Article 5

  • Total area: 60 hectares

  • Population: 10

  • Main transfer of— Area located to the east of Parkside Colliery, to the north of Hermitage Lane, and to the west of the M6 motorway.

  • Transfer from Lancashire (West Lancashire) to Merseyside (St. Helens)—

  • Article 6

  • Total area: 10 hectares

  • Population: Nil

  • Transfer of—

  • Largely open area located south of Moss Farm and in the vicinity of Canholes Wood, so that boundary follows the western side of Coach Road.

  • Location of minor realignments (articles 3 and 5)

1.  In area north-east of Bold colliery and north-west of Burtonwood Brewery.

2.  In following neighbourhoods, to follow centre of Sankey Brook-Red Brow Wood/Vulcan Village/Sankey Valley Park/Mill Farm/Sankey Viaduct.

3.  At the Waterworks Lane bridge over the M6 motorway.
