Transfer of functions

2.—(1) Subject to the provisions of this Order, the functions of the Minister in connection with further education are, in relation to Wales, hereby transferred to the Secretary of State.

(2) The functions of the Minister in relation to the training and supply of teachers for primary and secondary education are, in relation to Wales, hereby transferred to the Secretary of State.

(3) The Minister's function of nominating a person for appointment to the Ancient Monuments Board for Wales (constituted under section 15(1) of the Ancient Monuments Consolidation and Amendment Act 1913), is hereby transferred to the Secretary of State.

(4) The powers to make regulations which were transferred by Article 3(1) of the Transfer of Functions (Wales) Order 1970 to the Minister and the Secretary of State for Wales, jointly, are hereby transferred to the Secretary of State.

(5) The functions conferred on the Secretary of State by this Order do not include any functions relating to the qualification (including medical fitness), probation, misconduct, remuneration or superannuation of teachers, or to the appointment of Her Majesty's Inspectors; and any such functions (whether relating to further education or to primary or secondary education) shall, in relation to Wales as well as in relation to England, be exercisable by the Minister.

(6) This Order does not transfer any functions of the Minister in relation to universities in Wales, except those under section 84 of the Education Act 1944 (consents to payment of grants by local education authorities).

(7) This Order does not transfer any functions of the Minister under the Education Act 1962, except the power to make regulations under section 3(a), (c) and (d), in respect of persons ordinarily resident in Wales, and to pay grants under any such regulations.
