Section 1: Commissioner for Patient Safety

  1. Section 1 relates to the establishment of a Patient Safety Commissioner and sets out the core duties of the Patient Safety Commissioner in relation to medicines and medical devices in England. This section of the Act should be read with Schedule 1.
  2. Subsection (1) places a duty on the Secretary of State to appoint a Commissioner for Patient Safety.
  3. Subsection (2) sets out that the Commissioner’s core duties are to promote the safety of patients with regard to the use of medicines and medical devices; and promote the importance of the views of patients and other members of the public in relation to the safety of medicines and medical devices.
  4. Subsection (3) prevents the Commissioner from being regarded as a servant or agent of the Crown or as enjoying any status, immunity or privilege of the Crown.
