Territorial extent and application
- Section 4(6) and (7) sets out the territorial extent of the Act, that is the jurisdictions of which the Act forms part of the law. The extent of an Act can be different from its application. Application is about where an Act produces a practical effect. Subject to certain exceptions, the provisions of the Act extend and apply to England and Wales only. Therefore:
- Section 1(1) to (4) extend and apply to the United Kingdom.
- Section 1(5) extends and applies to England and Wales, and Scotland.
- Section 1(6) and (7) extend and apply to England and Wales only.
- Section 2(1) and (3) extend and apply to England and Wales only.
- Section 2(2) extends to the United Kingdom but applies to England and Wales only.
- Section 3 introduces the Schedule, Part 1 of which extends and applies to England and Wales and Part 2 of which extends and applies to the United Kingdom.
- Section 4 makes the necessary legal provision for the short-title of the Act, commencement and extent, and extends to the United Kingdom.
