This is the original version (as it was originally enacted).
A parish council may repair and maintain all or any of the public ways (not being highways or footpaths at the side of a highway within the meaning of the [41 & 42 Vict. c. 51.] Roads and Bridges (Scotland) Act, 1878) within the parish, and the expense of such repair and maintenance shall be defrayed out of the special parish rate, but this power shall not nor shall the exercise thereof relieve any other authority or person from any liability with respect to such repair or maintenance ; and such repair or maintenance shall not involve the parish council in any liability for damages to person or property resulting from the condition in which any such way may be maintained.
