The Secretary of State makes these Regulations in exercise of the powers conferred by regulations 22 and 24(2) of the Ecodesign for Energy-Related Products Regulations 2010(1) (“the 2010 Regulations”) and Articles 11 and 11A(3) of Regulation (EU) 2017/1369 of the European Parliament and of the Council of 4 July 2017 setting a framework for energy labelling and repealing Directive 2010/30/EU(2) (“the Framework Regulation”).
A draft of this instrument was laid before Parliament in accordance with regulation 24(1)(b) of the 2010 Regulations and Article 11A(2)(b) of the Framework Regulation, and approved by a resolution of each House of Parliament.
For the purposes of regulation 22(1) of the 2010 Regulations, the Secretary of State considers that the requirements set out in regulation 22(2) and (6) are satisfied. The Secretary of State has complied with regulation 22(4) of those Regulations.
For the purposes of Article 11(1) of the Framework Regulation, the Secretary of State considers that the conditions set out in Article 11(1)(a) to (d) are satisfied. The Secretary of State has complied with Article 11(2) of that Regulation.
S.I. 2010/2617; regulations 22 and 24 of S.I. 2010/2617 were inserted by S.I. 2019/539 (as amended by S.I. 2020/1528). The powers in those Regulations may be exercised to amend retained direct minor EU legislation by virtue of paragraph 10 of Schedule 8 to the European Union (Withdrawal) Act 2018 (c. 16).
EUR 2017/1369; Article 11 was substituted by, and Article 11A inserted by, S.I. 2019/539 (as amended by S.I. 2020/1528). The powers in those Articles may be exercised to amend direct minor legislation by virtue of paragraph 10 of Schedule 8 to the European Union (Withdrawal) Act 2018.
