The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 27(2) and (3) of the Social Security (Amendment) (Scotland) Act 2025(1).
Citation, commencement and interpretation
1.—(1) These Regulations may be cited as the Social Security (Amendment) (Scotland) Act 2025 (Commencement No. 3) Regulations 2026 and come into force on 2 November 2026.
(2) In these Regulations, “the 2025 Act” means the Social Security (Amendment) (Scotland) Act 2025.
Appointed Day
2. 2 November 2026 is the day appointed for the coming into force of section 19 (recovery of value of assistance from compensation payments) of the 2025 Act(2) only for the purpose of enabling the Scottish Ministers to make regulations under the provisions of the 2018 Act which are to be inserted by section 19(2) of the 2025 Act and are specified in column 1 of the table in the schedule (the subject matters of which are specified in column 2 of that table).

Explanatory Note
(This note is not part of the Regulations)
These Regulations bring into force section 19 of the Social Security (Amendment) (Scotland) Act 2025 on 2 November 2026 but only for the purpose of exercising the regulation-making powers in new Part 6A of the Social Security (Scotland) Act 2018 specified in column 1 of the table in the schedule.
