The Scottish Ministers make the following Regulations in exercise of the power conferred by section 63(2) of the Planning (Scotland) Act 2019(1).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Planning (Scotland) Act 2019 (Commencement No. 8) Regulations 2021 and come into force on 22 January 2022.

(2) In these Regulations “the Act” means the Planning (Scotland) Act 2019.

Appointed day – local place plans

2.—(1) Subject to paragraph (2), the day appointed for the coming into force of section 14(1), (3) and (7) (local place plans) of the Act, in so far as not already in force, is 22 January 2022.

(2) Section 14(1) of the Act comes into force on 22 January 2022 only for the purpose of the commencement of section 14(3) and (7) of the Act.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring section 14(3) and (7) (local place plans) of the Planning (Scotland) Act 2019 (“the Act”) fully into force on 22 January 2022. Section 14(1) comes into force for the limited purpose of the commencement of those provisions.

Section 14(7) inserts schedule 19 into the Town and Country Planning (Scotland) Act 1997 (“the 1997 Act”). Section 14 was commenced on 8 November 2019 for the limited purpose of enabling regulations to be made under schedule 19 of the 1997 Act.

The Bill for the Act received Royal Assent on 25 July 2019. Sections 58 to 61, 63 and 64 came into force on the following day.
