EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020 (“the International Travel Regulations”).

Regulation 3 amends regulation 7A which sets out the circumstances in which a person who arrives in Scotland via the common travel area who has in the previous 10 days departed from, or transited through, an acute risk country or territory is exempt from the requirements under regulation 6A (requirement to possess a managed self-isolation package) and 6B (requirement to stay in managed accommodation). A person who has travelled to the United Kingdom for the purpose of transporting material containing human cells or blood for use in the provision of healthcare by a healthcare provider will be exempt from these two requirements with effect from 4.00 a.m. on 23 April 2021.

Regulation 4 amends the list of acute risk countries and territories specified in schedule A2 of the International Travel Regulations. India is added to the list of acute risk countries and territories. The effect is that in addition to existing restrictions, as of 4.00 a.m. on 23 April 2021, a person who arrives in Scotland via the common travel area who has in the previous 10 days departed from, or transited through, India may only enter Scotland at a designated airport, and they must be in possession of a managed self-isolation package.

Regulation 5 amends schedule 1 which lists the passenger information a person who is subject to regulation 3 must provide. With effect from 26 April 2021 such a person must provide the name of the country which issued their passport or travel document, not the name of the issuing authority.

Regulation 6 amends schedule 3A to add the World Mixed Doubles Curling Championship to the list of specified competitions for the purposes of the exemption under paragraph 38 of schedule 2.

Regulation 7 makes savings provision such that a person who arrives in Scotland on or after 8 June 2020, but before the coming into effect of an amendment made by these Regulations, must comply with the International Travel Regulations as they were at the time at which the person arrived in Scotland.
