The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 94(1)(b)(i) and 122(2) of the Public Health etc. (Scotland) Act 2008(1), and all other powers enabling them to do so.
In accordance with section 122(6) of that Act, the Scottish Ministers consider that these Regulations need to be made urgently, without a draft having been laid before, and approved by resolution of, the Scottish Parliament.
1.—(1) These Regulations may be cited as the Health Protection (Coronavirus) (International Travel) (Scotland) Amendment (No. 9) Regulations 2021.
(2) Subject to paragraph (3) below, these Regulations come into force at 4.00 a.m. on 23 April 2021.
(3) Regulation 5 comes into force on 26 April 2021.
2. The Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020(2) are amended in accordance with regulations 3 to 7.
3. In regulation 7A(3)(b) (persons not required to comply with regulation 6A or 6B)(3)—
(a)omit “or”,
(b)after “17” insert “or 30”.
4. In schedule A2 (acute risk countries, territories or parts thereof)(4) after “Guyana” insert “India”.
5. In schedule 1 (passenger information) in paragraph 1(d) for “issuing authority” substitute “country of issue”.
6. In schedule 3A (specified competitions)(5) in Part 1 after “European Grand Slam Curling” insert—
“25A. Curling – World Mixed Doubles Championship.”.
7.—(1) Subject to paragraph (2), the amendments made by these Regulations do not apply in relation to any person who arrived in Scotland during the period beginning at 12.01 a.m. on 8 June 2020 and ending immediately prior to the coming into force of these Regulations in accordance with regulation 1(2), and the Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020 continue to apply to such persons as if the amendments made by these Regulations had not been made.
(2) The amendment made by regulation 5 of these Regulations does not apply in relation to any person who arrived in Scotland during the period beginning at 12.01 a.m. on 8 June 2020 and ending immediately prior to the coming into force of regulation 5 in accordance with regulation 1(3), and the Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020 continue to apply to such person as if the amendment made by regulation 5 of these Regulations had not been made.

These Regulations amend the Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020 (“the International Travel Regulations”).
Regulation 3 amends regulation 7A which sets out the circumstances in which a person who arrives in Scotland via the common travel area who has in the previous 10 days departed from, or transited through, an acute risk country or territory is exempt from the requirements under regulation 6A (requirement to possess a managed self-isolation package) and 6B (requirement to stay in managed accommodation). A person who has travelled to the United Kingdom for the purpose of transporting material containing human cells or blood for use in the provision of healthcare by a healthcare provider will be exempt from these two requirements with effect from 4.00 a.m. on 23 April 2021.
Regulation 4 amends the list of acute risk countries and territories specified in schedule A2 of the International Travel Regulations. India is added to the list of acute risk countries and territories. The effect is that in addition to existing restrictions, as of 4.00 a.m. on 23 April 2021, a person who arrives in Scotland via the common travel area who has in the previous 10 days departed from, or transited through, India may only enter Scotland at a designated airport, and they must be in possession of a managed self-isolation package.
Regulation 5 amends schedule 1 which lists the passenger information a person who is subject to regulation 3 must provide. With effect from 26 April 2021 such a person must provide the name of the country which issued their passport or travel document, not the name of the issuing authority.
Regulation 6 amends schedule 3A to add the World Mixed Doubles Curling Championship to the list of specified competitions for the purposes of the exemption under paragraph 38 of schedule 2.
Regulation 7 makes savings provision such that a person who arrives in Scotland on or after 8 June 2020, but before the coming into effect of an amendment made by these Regulations, must comply with the International Travel Regulations as they were at the time at which the person arrived in Scotland.
