The Scheduled Monument Consent Procedure (Scotland) Regulations 2015

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make provision in respect of applications for scheduled monument consent and applications for variation or discharge of conditions attached to scheduled monument consent.

The Regulations also make provision as to the certificates which must accompany certain applications and prescribe the forms of notice which must be given by the applicant to owners of the monument to which the application relates (regulation 5). The Regulations also prescribe the forms of decision notices to be given to the applicant (regulation 8).

In addition, the Regulations make provision as to the person who is to be treated as the owner of the monument for the purposes of such notices and certificates (regulation 5).

Regulation 14 revokes the Ancient Monuments and Archaeological Areas (Applications for Scheduled Monument Consent) (Scotland) Regulations 2011 but provides that these Regulations continue to apply to applications for scheduled monument consent made before 1st October 2015.
