The Scottish Ministers make the following Order in exercise of the powers conferred by sections 4(1) and 10(2) of the Health Boards (Membership and Elections) (Scotland) Act 2009(1) and all other powers enabling them to do so.
In accordance with section 4(4) of that Act(2), a draft of this Order has been laid before and approved by resolution of the Scottish Parliament.
1. This Order may be cited as the Health Boards (Membership and Elections) (Scotland) Order 2013 and comes into force on 31st December 2013.
2. The Health Boards (Membership and Elections) (Scotland) Act 2009 (Commencement No. 1) Order 2009(3) is revoked.
3.—(1) Notwithstanding article 2, section 1(1) to (5) and (7) of the Act continues in force for the specified areas.
(2) Section 6(4) of the Act has effect only in respect of the specified areas.
(3) In this article—
“the Act” means the Health Boards (Membership and Elections) (Scotland) Act 2009;
“specified areas” means the areas for which—
Fife Health Board; and
Dumfries and Galloway Health Board,
are constituted(4).

This Order revokes the Health Boards (Membership and Elections) (Scotland) Act 2009 (Commencement No. 1) Order 2009, which commenced sections 1 to 3 of the Health Boards (Membership and Elections) (Scotland) Act 2009 in respect of Fife and Dumfries and Galloway Health Board areas for the purpose of piloting Health Board elections in those areas. This Order brings the pilot scheme to an end in terms of section 6 of the 2009 Act. The Order also makes incidental, consequential and saving provision.
Section 4(4) has been modified by paragraph 5 of schedule 3 to the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).
Fife Health Board and Dumfries and Galloway Health Board are constituted by the National Health Service (Constitution of Health Boards) (Scotland) Order 1974 (S.I. 1974/267), as amended by S.S.I. 2003/217 and S.S.I. 2006/32.
