The Scottish Ministers make the following Order in exercise of the power conferred by section 17(2) of the Protection of Children (Scotland) Act 2003(1) and all other powers enabling them to do so.
1.—(1) This Order may be cited as the Protection of Children (Scotland) Act 2003 (The Meaning of Disqualified from Working with Children: Corresponding Disqualifications in Northern Ireland) Order 2009.
(2) This Order comes into force on 1st April 2009.
2.—(1) Disqualification from working with children in accordance with article 30(4)(a) or (b) (persons disqualified from working with children: offences) of the Protection of Children and Vulnerable Adults (Northern Ireland) Order 2003(2) are disqualifications which correspond to disqualification from working with children by virtue of section 17(1)(a) (meaning of “disqualified from working with children”) of the Protection of Children (Scotland) Act 2003.
(2) Disqualification from working with children in accordance with article 30(4)(c) of the Protection of Children and Vulnerable Adults (Northern Ireland) Order 2003 is a disqualification which corresponds to disqualification from working with children by virtue of section 17(1)(d) of the Protection of Children (Scotland) Act 2003.

This Order, made under section 17(2) (meaning of “disqualified from working with children”) of the Protection of Children (Scotland) Act 2003 (“the 2003 Act”) provides that disqualification from working with children under article 30(4)(a), (b) or (c) (persons disqualified from working with children: offences) of the Protection of Children and Vulnerable Adults (Northern Ireland) Order 2003 are disqualifications from working with children which correspond to disqualification from working with children by virtue of section 17(1)(a) or (d) of the 2003 Act, as the case may be.
Section 11 (offences relating to work in a child care position) of the 2003 Act provides for offences relating to persons who are disqualified from working with children applying for, offering to do, accepting or doing any work in a child care position.
