The Scottish Ministers, in exercise of the powers conferred by section 8(3) of the Transport (Scotland) Act 2005(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Regional Transport Strategies (Health Boards) (Scotland) Order 2006 and shall come into force on 1st January 2007.

Interpretation

2.  In this Order “Transport Partnership” means a Transport Partnership established by the Regional Transport Partnerships (Establishment, Constitution and Membership) (Scotland) Order 2005(2).

Regional transport strategies and Health Boards

3.  For the purposes of section 8(2) of the Transport (Scotland) Act 2005 (duty of Health Boards as respects regional transport strategies), each Health Board set out in column 1 of the Schedule is specified in relation to the (or, as the case may be, each) Transport Partnership which is set out in the corresponding entry in column 2 of the Schedule.

Explanatory Note

(This note is not part of the Order)

Section 8(2) of the Transport (Scotland) Act 2005 places each Health Board under a duty to, so far as possible, perform those of its functions and activities which relate to or which affect or are affected by transport consistently with the transport strategy of the (or, as the case may be, each) Transport Partnership in relation to which it is specified.

This Order, made in exercise of the powers contained in section 8(3) of the Act, specifies, as respects each Health Board, which Transport Partnership’s transport strategy is, or which Transport Partnerships' transport strategies are, for the purposes of section 8(2), the strategy or strategies consistently with which the Board is to perform its functions.

The name of the region was changed from Central and Tay to Tayside and Central by the Transport Partnership in accordance with the procedure contained in article 3(4) of S.S.I. 2005/622.
