This Order brings into force on 1st August 2003 section 15 of the Standards in Scotland’s Schools etc. Act 2000. Section 15 establishes a statutory presumption in favour of “mainstream education” where an education authority is providing school education. “Mainstream education” in this context refers to education in a school other than a special school. Section 15 also recognises that a mainstream setting may not be appropriate in all cases and sets out circumstances where an education authority may decide to offer education in a special school.
