The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:
1.—(1) These Regulations may be cited as the Farm and Conservation Grant Amendment (Scotland) Regulations 2001 and shall come into force on 30th October 2001.
(2) These Regulations extend to Scotland only.
2. Regulation 6(5)(b) (six year limitation on the incurring of expenditure) of the Farm and Conservation Grant Regulations 1991(2) shall be omitted.

These Regulations make a minor amendment to the Farm and Conservation Grant Regulations 1991 as a consequence of the necessary restrictions in place as a result of Foot-and-Mouth disease, which has meant that certain farmers have not been able to complete projects grant assisted under the scheme in the time scales specified in the particular grant approval.
The Scottish Ministers have agreed to delay the dates for completion of such projects in the south of Scotland in circumstances where they are satisfied that such projects were unable to be completed on time as a direct consequence of the Foot-and-Mouth disease restrictions.
In order to allow for this, the time limitation contained in regulation 6(5)(b) of the Farm and Conservation Grant Regulations 1991 for the incurring of expenditure requires to be lifted.
1972 c. 68. Section 2(2) was amended by the Scotland Act 1998 (c. 46), Schedule 8, paragraph 15(3). The function conferred upon the Minister of the Crown under section 2(2) of the 1972 Act, insofar as within devolved competence, was transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.
