Coming into operation-
1st June 2026
The Department for Infrastructure(1), being satisfied that satisfactory provision is made by the laws of the territories specified in this Order as respects the granting of driving licences of the description specified in this Order, makes the following Order in exercise of the powers conferred by Articles 19D(2)(b), (2A), and (2B) and 218 of the Road Traffic (Northern Ireland) Order 1981(2) and now vested in it(3).
1. This Order may be cited as the Motor Vehicles (Exchangeable Licences) (Amendment) Order (Northern Ireland) 2026 and shall come into operation on 1st June 2026.
2.—(1) The Motor Vehicles (Exchangeable Licences) Order (Northern Ireland) 2022(4) is amended in accordance with paragraph (2) to (8).
(2) In Article 2(1) (interpretation) for the definition of “Table 1, Table 2 and Table 3” substitute—
““Table 1, Table 2, Table 3 and Table 4” mean the Tables in Schedule 1 bearing those numbers;”.
(3) In Article 3 (designation of countries and territories)—
(a)in paragraph (1) for “paragraphs (3), (4), and (5)” substitute “paragraphs (3), (4), (4A) and (5)”;
(b)in paragraph (2)(b)(ii)(cc) for “Table 2 or Table 3” substitute “Table 2, Table 3 or Table 4”;
(c)after paragraph (4) insert—
“(4A) A licence of a description specified in paragraph (2)(b)(ii), being a licence granted by way of exchange for a licence granted to a person who has passed a driving test in a country or territory specified in Table 4 shall not be exchangeable in so far as it authorises the driving of a class of vehicle corresponding to a class of vehicle included in licensing category AM, B+E, F, K or Q or sub-category A1 or A2, notwithstanding that the licence authorises the driving in the country or territory specified in Table 1, table 2 or Table 3 of a class of vehicle corresponding to that licensing category.”.
(4) In Article 5 in paragraph (2)(a)(ii)(cc) for “Table 1 or 2” substitute “Table 1, Table 2 or Table 4”.
(5) After Article 5 insert—
“5A.—(1) Subject to paragraph (3), the countries and territories specified in Table 4 are designated under Article 19D(2)(b) of the Order as respects licences of the descriptions specified in paragraph (2).
(2) The licences referred to in paragraph (1) are licences which—
(a)authorise the driving of a class of vehicle corresponding to a class of vehicle included in licensing category B, and which have been granted by the licensing authority of a country or territory specified in Table 4—
(i)to a person who has passed a driving test in that country or territory; or
(ii)by way of exchange for a licence granted in—
(aa)an EEA state or the United Kingdom;
(bb)a country or territory specified in Table 1, Table 2 or Table 3; or
(cc)a country or territory specified in Schedule 2,
to a person who has passed a driving test in any such State, country or territory.
(3) Notwithstanding that a licence of a description specified in paragraph (2) authorises the driving of a vehicle with manual transmission that licence shall be exchangeable only to the extent that it authorises the driving of vehicles with automatic transmission if it was granted to a person who has passed a driving test in a vehicle with automatic transmission.”.
(6) In Article 6 in paragraph (2)(b)(ii)(bb) omit “Gibraltar” in each place that it appears.
(7) In Schedule 1 (designation of countries and territories)—
(a)in the title for “Articles 3, 4 and 5” substitute “Articles 3, 4, 5, 5A and 6”; and
(b)after Table 3 insert —

(8) In Schedule 2 (other countries and territories from where a licence may have been exchanged)—
(a)in the title for “Articles 3, 4, 5 and 6” substitute “Articles 3, 4, 5, 5A and 6”; and
(b)before “Guernsey” insert “Gibraltar”.

This Order amends the Motor Vehicles (Exchangeable Licences) Order (Northern Ireland 2022 (“the 2022 Order”) in order to designate Moldova under Article 19D(2)(b), (2A) and (2B) of the Road Traffic (Northern Ireland) Order 1981 (“the 1981 Order”) as making satisfactory provision for the granting of licences which authorise the driving of vehicles included in licensing category B (cars). This enables those driving licences to be exchanged for a corresponding Northern Ireland licence.
Moldova is designated in respect of those licences if the driving test was passed in Moldova or by way of exchange for a licence granted in the United Kingdom, an EEA State or any of the countries or territories specified in Table 1, Table 2 or Table 3 of Schedule 1 or in Schedule 2 to the 2022 Order where the driving test was passed in that country, territory or State.
A licence granted to a person who has passed a driving test in a vehicle with automatic transmission shall only be exchangeable to the extent that it authorises the driving of vehicles with automatic transmission.
The opportunity has also been taken to include Gibraltar in the list of countries in Schedule 2 as a country or territory from where a licence may have been exchanged. Licences issued in Gibraltar are included in the definition of exchangeable licence in Article 19D(1) of the 1981 Order and are exchangeable in their own right.
